.249 is oddly close to common limits. I wonder if that was the machine’s max.

In over a decade of practice, I’ve seen exactly two people max out the BAC reading on an Intoxilyzer. You have to be a blinding, every day alcoholic to hit those kind of numbers and be conversational. And you certainly wouldn’t blow flat shortly afterwards, as it would take about 16 hours for .249 to process out of your bloodstream.

That machine is calibrated to eliminate non-Bipocs in the work force.

Likely doesn’t have much to do with this situation.

People pursue and are successful in wrongful termination actions every day in at will states

Just wondering who performed test and are they trained in performing that test at a work place? If over the counter device was used, a lawsuit would be plausible?

You would think with that BAC reading, they’d ask you to retake it. that’s legit drunk.

Most people would be passed the frick out.

At 0.25 you’d have trouble forming sentences and would for sure be visibly drunk
true. But someone who would drink that much while at work would probably be able to hide it way better than the average person

Most jobs in oil & gas/petrochemical industry. Alcohol test is typically part of the random drug screenings.

Exactly. .25 and your the point of drunkenness that you would be pissing in your coworker’s trash cans… not arguing that you are stone sober.

No way you could drop from 0.249% to 0.00% in one hour, so one of those readings is definitely off.

Railroad has randoms. I'd guess most anything transportation related does.
