Correct. But it’s weird that it doesn’t say whether or not he was. I tried looking at other articles about it and found nothing. You’d think since it was rule justifiable, they’d release why they determined that.

Which is why I feel any regular joe would’ve been charged in this.

I get your point and I agree in the literal sense (though there is a reason laws, regs, and even insurance policies require "reasonable care" in many cases). I am not defending the thief at all and I am not rendering a verdict on the shooter since certain details are unknown.

My only point is if you don't want your car stolen, leaving it unlocked, running and unattended is poor risk management and decision making. You can't simply say, "This is fine because people shouldn't steal my car." You can't control every idiot with motive and opportunity. You can control the preventive measures you employ to mitigate the risk of an unwanted consequence.

People would rightfully call me an idiot if i came to the board complaining that someone stole my car that I left unlocked and running. I see no reason to spare this guy simply because he killed the thief.

No sympathy for thieves or killers, or rapists, child molesters, etc..

They should meet such an end.

Maybe if this became a regular occurrence without consequence we will see less thefts. I'd rather live than risk dying stealing.

Thats me though.

Either way, I am not upset that another POS is off the streets and we dont have to waste tax dollars on his jail time.

You’re 100% spot on and people should be able to separate your point from any endorsement of the thief.

If you don’t want your car stolen, you should take steps to prevent it from being stolen. Leaving it running on the side of the road would be taking steps in the opposite direction.

I for sure think that he is an idiot for leaving it unlocked and running but that doesn't give the POS justice to steal it. It also doesn't justify a criminal suit against him since for the POS's death.

You're not going out on a limb here. I'd be shocked if you could find anyone in this thread claiming theft is justified in this situation.

We'd have to dismiss the responses like "you deserved to have your car stolen for being an idiot" in my hypothetical thread though. Because you know they'd be in there.

It for sure is two totally different situations when talking about reaction if the situation was "Chicago Fire Lieutenant has vehicle stolen after leaving it unlocked and running" vs "Chicago Fire Lieutenant kills car thief".

Common sense does dictate that the Lieutenant is an idiot for what he did, but he had every right to do the next step when it was being stolen.

The neighborhood in Texas where John Horn killed the two men robbing his neighbors house several years ago as had no problem with burglary since then.

No he didn’t. He had every right to take the next step if his life was in danger, not just because the car was stolen.

If we're talking personal opinion, sure. If he was in Texas, also true from a legal standpoint. In Illinois, I'd say it depends. Looks like this guy may have according to the law, though who knows if that would be true for a normal citizen in the same exact situation in Illinois.

I would only agree if he was shooting into the car after it was past him. If the car is already gone by and you shoot through the back of him/car, no he didn't have the right. The fact he shot and hit him in the chest tells me the car had not past him yet and was coming in his direction, which yes gives him the right.

The question shouldn't be "when has it ever become" but rather "why shouldn't it be".
