The victim was identified as Nathaniel Joseph Rosa, 31, from Bothell, Wash., a city in the greater Seattle metropolitan area. It is about a two-hour drive northeast of Mason County, a relatively rural part of the state. “All the information that we have indicates that the guy was undressed, in the shower, taking a shower,” Lieutenant Adams said, adding that there was no indication that a physical altercation had taken place when Mr. Fanning discovered the stranger.

It's pretty hard to claim you are in fear for your safety when you have already successfully removed yourself from the situation once, and then willingly went back in and killed the guy.

I'm all for castle law but I probably wouldn't have shot the guy either in that manner. Just call the cops.

Dude is naked in the shower and you're armed. Assuming he didn't try to attack the homeowner, there are ways to deescalate the situation other than killing the guy. That should be an absolute last resort. Someone breaks into my house in the middle of the night, yea they're getting shot. Someone is naked in my shower then I'm calling the cops and sitting on the couch with my shotgun in my lap.

He left to go get a gun and came back to shoot a drunk in his shower. Gonna be hard to claim self defense.

I mean, it makes sense that you would wanna shoot an intruder in your house, but the better option here would have been to just call 911 right away and then wait in the other room with your gun at the ready.

I cannot back the homeowner on this one. He was in no danger and should have called police for the break in.

Did any of you people even read the WA law, were in the law is it stated he was required to be in fear of his safety, or could only use deadly force in self defense? He was protecting his property which is allowed by WA law, whether it was by reasonable means or not will probably be decided by a jury.

Yep, owner Farkas'd Up by telling about leaving and retrieving. If he had kept his mouth shut it would've been his word against a lot of conjecture.

I'm torn on these issues...

On one hand I completely agree with the logic of the "castle law" and "stand your ground" law.

On the other hand, people do mistakenly enter the wrong house.

For example...

I live in a "cookie cutter" neighborhood where many houses have the same floor plan. Two doors down from me is the exact same house as mine. The brick is a little different. The roof color is slightly different. But it's the same house.

My grandma was visiting from out of town, and after her morning walk she accidentally went inside the house 2 doors down from me. And she's old and it took her walking all the way into the living room for her to realize her mistake.

So would someone legally have the right to blow my grandma away for something so benign and innocent?

This guy's mistake was not calling police when he went back to the other house to retrieve his gun.
