How do you know that the threat wasn't made until the second time the homeowner confronted him?
Considering he left to get a gun and come back, it's safe to say he felt threatened the first go round, no?

No, but you are allowed to threaten deadly force to evict tresspassers inside your home. We don't know what happened in the bathroom exactly, but something tells me the home owner went well beyond his authority with this.

Yep, owner Farkas'd Up by telling about leaving and retrieving. If he had kept his mouth shut it would've been his word against a lot of conjecture. Further proof to the old saying: Don't talk to the cops without a lawyer.

Yep
Or now that I think about it maybe his story was the cover up and this was actually the result of a homosexual lovers quarrel.

Yeah I don't even understand why someone would want to shoot and kill a guy in your own shower.

I would be looking for every reason not to have to kill a guy in my own house unless it was completely necessary.

He should have just called the police when he left to retrieve his gun.

It's crazy as hell to come back and fire your gun and kill a guy in your own house. Psycho.

I'm not positive about this, but I think the law says you are not required to retreat from your home if there is an invader and are allowed to shoot them because you are in danger.

But if you do leave, you are out of danger. You cannot go back and put yourself back in danger to go kill the guy.

I'm pretty sure that's the issue here.

It's the kind of justice that needs to be self served more often but yeah, he killed that guy in cold blood and is going to jail.

Yeah. OK. This is murder. Sorry.

I normally lean heavily toward the homeowner but I have to agree.

Yeah. OK. This is murder. Sorry.

I normally have no problem with intruders dying, but this is the rare occasion when I can't 100% side with the homeowner.

he may have done a great service by ridding the world of some lunatic, but it's still murder.

Hell yes this is murder. The guy is an idiot though. He should have kept his damn mouth shut and let the facts of the case speak.

Don't get me wrong, he broke the law and will go to jail. I am not championing his gun rights or anything.

Do public schools in many states have people that look like this working with elementary school kids?

Do I shoot the unarmed intruder or call the police and be shot by them?

Doesn't apply in this instance. The homeowner left, retrieved a gun from his home next door, returned, then shot the intruder through the shower curtain. His life was never threatened and he should have just called law enforcement. He will likely spend a long time in jail...as he should.

Yeah, Bruce, I've beem wanting to talk to you about this. You may want to lay low for a while because you're wanted for murder.

Guy in the shower probably had a snub nose pistol in his hand.

Here is the problem. He left and came back. He should have called the cops. I think you should have the right to shoot the sob but the law is against him in this case.
