This is the price we pay for having elected DAs and judges. They aren’t able to be true servants to the law bc they have to keep their mobminded electorate happy.

There has to be someone smarter than me out there that can devise a plan were judges and prosecutors are kept score against each other with the egregious failures booted

Its the only way to make it a fair process

As it stands Joe Blow has to defend himself against unlimited money and unlimited time from taxpayer while being outnumbered at the same time

The warrant was just for the guns?

Impossible. Libs said this would never happen.

This is the world we live in today. Defund the police. Allow criminal element to destroy cities, loot, riot, destroy public property at will, burn businesses to the ground, beat and kill people who get in their way. AND due to the lack of the police protecting and serving a couple has to defend their own lives and property with their lawfully owned firearms. THEN, same local government issues search warrants for the private citizens home who were simply protecting their home In order to search for guns, and then seize a lawfully owned gun in the process.

You know who should truly be protesting right now, and deservingly so? Private citizens who have to resort to their own personal defense because their own local government is in such dereliction of their duties to protect their citizens from the refuse of society, that this becomes necessary to do so.

COVID might prove to be a blessing in some ways. People can telework so they will move further out from cities than ever before and these idiot protestors and law enforcement can wallow in the suck that is their city.

If this is true, one of the more troubling parts of this situation is the POLICE came and seized the weapons of the folks defending their home against ANTI-POLICE protesters. It’s quite the conundrum.

Given their legal experience, and being rich AF, this has the potential to be a Supreme Court case.

I agree but there’s been a dangerous trend lately where the Supreme Court is choosing not to hear cases or intervene when states violate Constitutional rights.

Update to the story

quote:

St. Louis police have applied for warrants in the case of the Central West End couple who pointed guns at protesters on their street. St. Louis Police Chief John Hayden on Tuesday told News 4 they applied for warrants but did not elaborate on what those warrants allege or who they are against. The guns were turned over to police as evidence.

quote:

“The hostility is what I noticed,” Hayden said. “I don’t want to see guns out when people are very hostile and angry at each other. Those are recipes for violence, so again we applied on warrant, there’s been follow up information and we are waiting on the decision on the warrant application.

quote:

The Metropolitan Police turned over an “unlawful use of weapon” case to the Circuit Attorney’s office.

I don’t know why the police feel the need to persecute this couple, but it seems to be there is a battle for the soul of America being waged.

worth noting that MO Gov. Parson has come out and voiced his support for the couple expressing their 2A rights.

The story here is not so much that the guns were seized - they appear to have been taken into evidence under a search warrant - but that the police referred an “unlawful use of a weapon” charge to the DA. Here’s the statute in question, and I guess this is the part they are looking at:
quote:

*571.030. Unlawful use of weapons — exceptions — penalties. — 1. A person commits the offense of unlawful use of weapons, except as otherwise provided by sections 571.101 to 571.121, if he or she knowingly:
. . .
(4) Exhibits, in the presence of one or more persons, any weapon readily capable of lethal use in an angry or threatening manner;

I can’t imagine this holds water though, given this exception:
quote:

5. Subdivisions (3), (4), (5), (6), (7), (8), (9), and (10) of subsection 1 of this section shall not apply to persons who are engaged in a lawful act of defense pursuant to section 563.031.

It’s pretty crazy if they actually get charged. It’s a class E felony if they are convicted.

Anyhow, I don’t really see an issue with them collecting the guns as evidence in a felony investigation. To me the issue is that they are considering charges in the first place. I realize that distinction probably doesn’t matter to a lot of folks.

When I first saw the story I thought "I really wish this couple had mowed down all these rioters".....

Now, I'm feeling the same way about EVERYONE involved in persecuting them.

I’m all about 2A but was it necessary for them to point the guns at the rioters? Did they cal 911 to say their life was endanger? If they would have just went outside with guns and been on the phone with 911 they are likely not in trouble here. I haven’t seen video so I don’t know the whole story. I don’t have an issue with them going outside with guns, but I think pointing them at people when their life was not yet in jeopardy is what has them in hot water. The charges will likely be dropped.
