Obviously not a lawyer, but from what I understand the game plan here is that the blood test happens hours later than the refused breathalyzer would have taken place. In the time elapsed, the hope would be that the liver goes to work and ones BAC drops below the the legal limit. Of course, the prosecutor will bring up the metabolic rate of alcohol, and theoretically what that means his BAC would have been able the time of the accident, but if the only available evidence shows a BAC below 0.08, it is much easier to argue innocence than with a failed breathalyzer test. At least, that's my understanding.

Source: Never been so much as pulled over for DUI, so I know nothing.

If it is an accident with injury, the blood test would be mandatory if I am not mistaken. A person has the right to refuse a breath test. However,
the refusal of the test can cause one to have harsher penalties.

People of New Orleans need to protest and march until he is held accountable and resigns.

Everyone is all about cancel culture for those that make a negative impact to public safety, it goes both ways - him losing his seat on council might make someone else think twice about driving impaired if they know there are real consequences for actions.

I saw a black suv with police lights and a man in a suit driving. I guess council gets police lights too.

Holy shite. That's the one we saw plow down Bourbon Saturday. Same suv. Same looking driver. Dude put on lights and went quick through the crowd.

that's the driver from the other vehicle, he's injured. EMS arrived 30 minutes later, police an hour. That means no one called the police immediately. So the city councilman didn't even bother to call 911 even though the other person was injured. He's driving what is essentially a police vehicle, and he's out of jail in 45 minutes.

There's them, and then there's the rest of us.
