Who did he call? They should get access to his cell phone to find out who he called first and what did he say. He obviously looked drunk. Why no field sobriety test? There is way to much to this story than to just let it be swept under the rug. He should be treated the same as any other citizen. They need to look at their public vehicle policy. How many other DUI's did he have that never were reported.

Obviously not a lawyer, but from what I understand the game plan here is that the blood test happens hours later than the refused breathalyzer would have taken place. In the time elapsed, the hope would be that the liver goes to work and ones BAC drops below the the legal limit. Of course, the prosecutor will bring up the metabolic rate of alcohol, and theoretically what that means his BAC would have been able the time of the accident, but if the only available evidence shows a BAC below 0.08, it is much easier to argue innocence than with a failed breathalyzer test. At least, that's my understanding.

Source: Never been so much as pulled over for DUI, so I know nothing.
