Of course. This prevents people from getting away with saying "I didn't read the contract" any time they spot a contract term they don't like.

Contracts exist for a reason, it isn't just a legal dance.

I don't believe they would drag off a paying passenger just to let the standby crew fly. Especially using 3 security guys to drag him off. Something else happened here. I also don't believe a doctor would scream and make noises like that to put up a fight

Provided the contract spells out they can do that (hint - it does), absolutely it's ok.

You are forgetting the fact that passengers who get bumped get vouchers worth more than the flight. Considerably more.

This whole discussion is depressing. Best thing you can hope for is the public demands change, but they have no recourse because all of the airlines have identical language for overselling in their contracts.

Best case scenario is that the public boycotts UA and they lose lots of revenue- which in turn prompts them to end overselling.

I doubt it happens, but you can hope.

The problem is eliminating oversells will lead to just as many, if not more issues.

Equipment swaps and weather delays still happen. So now since you can't oversell a flight, you end up with more passengers delayed even longer, and less options for them to rebook.

However much it takes. No one forced UAL to overbook. I understand why they do it and it's fine...just pay if it doesn't work.
And on Sunday night, when the plane is full of tired people needing to be at work the next morning, or business people trying to get to a city for a key meeting, it's no surprise that $800 doesn't cut it.
And let's not forget, they were kicking people off so THEIR employees could be at work, giving the finger to other business' employees.
Allowing the airlines to do this is nothing but a protectionist subsidy. This is the type of regulation - pure protectionism - that Trump should eliminate - instead of deregulating externalities which does nothing but place part of the cost of production on society and the taxpayers.
If the price is $10,000 to get people to move, then pay it. Free Market.
In any event, $800 is way, way light.

They try to find out by offering a certain amount of money for volunteers, and raising it if there aren't any takers.

They already do this. And I think you missed the point.


Say JetBlue has 2 flights today from BOS-MSY...

- The earlier flight is swapped out from an A321 to an A320. The A321 was booked full, but not oversold. Now they've got 50 passengers needing to get to MSY.

- Other airlines don't have space available today and no one is willing to volunteer.

- The later flight has 20 seats available. Okay, the first 20 people are booked there.

- There's 20 seats left on a connecting BOS-JFK-MSY flight. Now we need to reassign 10.

- The remaining 10 are rebooked for flights tomorrow.

- The later direct BOS-MSY and BOS-JFK-MSY flights go out with 5 seats open on each because of no-shows of people originally booked. All 50 passengers would have made it to MSY tonight in the current format of allowing oversells, but not in your proposed format.

Man, I HATE the way this ends up happening at times but I have to say the overbooking angle isn't the right complaint.

Not all planes are the same size. Occasionally a craft needs to be switched out due to mechanical,etc.

So, airline sells 250 seats on a plane, which has a mechanical issue last minite. No similar plane is immediately available but a 220 passenger plane is there. So, options are to delay 250 people a long time and probably a cascade of issues after due to flight crews not making destinations, or delay 30 people a little while and pay them for it.

That's just 1 scenario

The issue is that the airline shoulda raised the ante until it got what it needed.

Having shitty terms in a contract does not excuse poor service. Just because you can legally do something doesn't mean you should.
