I don’t get the connection between Kobe’s life insurance policy and the lawsuit.
The life insurer should pay the claim and then subrogate against the helicopter company.
Life insurance isn’t a liability policy, so it functions differently than an automobile policy.
Of course, there are probably other strategic reasons why she’s filing suit; someone mentioned in anticipation of Kobe’s estate being sued by the other victims, which makes sense.

Stupid question: we’re blaming the pilot but wasn’t he cleared to fly? Or does that clearance essentially change real time pending the conditions and he should know better and make adjustments?

He was cleared to fly visually. When he went into the clouds and encountered IMC weather he did not obey FAA rules and broke the law.

Judges don't just magically throw shite out. The pilot's family (estate) will incur legal fees and a lot of bullshite before this ever goes in front of a judge. There are no innocent bystanders in a lawsuit. Best case scenario is the pilot was heavily insured and the insurance company will pay the legal fees. Even then the family will have to deal with this shite while still grieving.
