The first lawsuit has been filed against the manufacturer of the gun used in the Uvalde mass shooting at Robb Elementary School.

The legal suit against Daniel Defense was filed Thursday on behalf of Emilia Marin, a school staff member, according to a report by NBC News.

quote:

Marin’s attorney Don Flanary shared that Marin was not physically harmed in the shooting, but is struggling following the event.

“She is not well psychologically. She is a wreck,” he said. “She’s been to her doctor and she’s continuing to receive treatment. It’s going to be a long road ahead, as it is for so many other people.”

The report described Marin as a staff member who had brought food to the school for an end-of-the-year party. She ran inside of the school and closed the side door after reportedly seeing the shooter outside, but the door did not automatically lock as designed.

quote:

The filing is a pre-suit petition rather than a formal lawsuit. The action seeks to determine whether the gun manufacturer can be sued over the operation of its weapons.

I have a feeling there was an activist group involved that approached this woman about attaching her name to something the activist have been waiting to do.

I think Ford has killed more people than that gun manufacture.

Maybe she should sue them.

All of these lawsuits involve gun-control activist groups. Either they provide the lawyers or the funding.

The gun did not shoot itself at all those children. The only one to blame is the one who went in there and did it. Even the teacher who didn’t lock the door shouldn’t be blamed because she did not shoot anyone.

Right. Its not organic, as I said I have no doubt an activist group was fishing for a willing teacher to put her name on the suit. Its just gross and disgusting and everything I hate about politics.

True, and they usually don’t have a problem finding a willing “victim” to participate in a lawsuit as the plaintiff.

However,

Marin was not physically harmed in the shooting

frick her. There are families that lost children or still have kids in the hospital, and she is the first to file a lawsuit against a manufacturer? Not the family of the psycho or the inept local law enforcement, but the gun.

When are attorneys going to start being held responsible for court filings that clearly will not be upheld? What is the point of their professional license if they are not required to have a minimal understanding and responsibility in presenting cases to the courts?

Garbage lawsuit.

ETA: She should also sue the door manufacturer for making doors that could be left opened.

Did the gun fire itself?

When she loses she should be forced to pay damages to the manufacturer to stop this stupid shite

The attorneys for the manufacturer will likely file a grievance against her lawyer(s) alleging exactly what you are saying.

Think I found a better candidate for a manufacturer at fault here

They'll have a problem with that one because they've already publicly admitted to regularly leaving the door propped open with a rock.

They'd probably have a better case. Of, course the door could still have locking issues, but that doesn't change that the teachers/school have already admitted that they'd regularly prop the door open with a rock. Then, there's the question of if the school was aware of the faulty lock prior to that day.
