Only reason this can be enforced is because Harvard accepts lots of federal funding (>$1 billion a year).

If Harvard rejects that federal funding, they'll again be allowed to discriminate.

But I suspect Harvard is just going to drop test scores and rely on students writing about their race in their essays which is still constitutional.

I taught night classes at a community college 6-7 years ago. I had the valedictorian of an inner-city Birmingham high school in my class. She couldn't write a paragraph. It was absurd how behind she was considering she had the highest GPA of her graduating high school class.

Good person. Seemed driven to be successful. But she had absolutely zero reason to be taking college courses without serious remediation.

Is it still constitutional? Couldn't someone argue that it's just a means of enacting a race-based affirmative action program?

Yeah, that's still constitutional.

All universities will do is ask for diversity statements and get diversity that way.

This case doesn't rule that out (they should have but they didn't).

I didn't find it particularly compelling. It doesn't come close to addressing how a student will do once they get into college. By that time, K-12 is over. There's no time to properly prepare them for college.

She talks about wealth disparity based on incomes among college graduates, white vs. black. That's too broad. Compare the incomes vs race vs major chosen. If majors with low income prospects are chosen more often by one group, then, of course, the incomes will be lower on average.

She then starts talking about the consideration of race on the application as if it is a minor distinction; it's just one of the many parts of the holistic application process. Well, if it's so minor, then why fight so hard to have it?

The UNC policy states "reviewers may also consider the race or ethnicity of any student (if that information is provided) in light of UNC's interest in diversity. And, yes, the race or ethnicity of any student may - or may not - receive a 'plus' in the evaluation process depending on the individual circumstances revealed in the student's application." so, because A.) Any prospect student can state their race on the application, and, B.) it may or may not be considered as a 'plus' for their admittance, it's entirely fair. I think that depends on all the criteria how they are weighted relative to each other.

The logic doesn't add up.

Maybe Democrats will change their tune when a shite load of their northeastern donors start losing their shite when their kid's target school goes 40% Asian over the next few years.
