Customer lists aren't always provided by the company, dumbass.

Salespeople have to go out and earn customers, dumbass.

Sometimes salespeople even bring former customers to a new company, dumbass.

I had a roommate out of college that worked for probably 3 different companies in the 1 year i lived with him. He signed 3 non competes with all of them. He did sales for 3PL’s. Each time he went to a new company, he just went and got his old customers. They didn’t do shite

To be enforceable in most places a non-compete agreement has to be limited in scope, only good for a limited time period, and restricted as to the geographic area where it will apply. Except in very rare specialized cases most courts have decided that a previous employer should not be able to restrict a former employee from making a living in a specific field without limitations, allowing only for reasonable restrictions to protect the former employers business. Many are never enforced due to the value of any lost revenue probably being less than the legal cost to enforce the agreement.

I had to file a grievance because they tried to fire me because I didn't bend my knees while fueling a package car. I asked them to show me the safety video of how to fuel a package car and they said they couldn't find it.

Right to work state.

Union workers are lazy whinny employees whose membership as a percentage of the USA workforce has dropped in half since 1983. Unions are a cancer that suck the life out of American companies and have driven many American corporations into bankruptcy over the years.

I hope UPS girly men go on strike. Non-union FED EX could use the extra business.

Meanwhile, unions will hopefully keep shrinking into oblivion.

In TX their also has to be a reasonable $ buy out as well, for the non compete to be enforceable.

Even then, medical professionals (my experience with non competes) can still say that limiting their ability to work/practice is a detriment to the public and the courts don't end up enforcing the non compete.

Dont even care. We ship Fedex. We have since your last strike when you cost my business a ton of money.

My purchase orders even say we prefer to have things shipped fedex over UPS. I wont refuse a package but I certainly dont ask for UPS.

Its been years and I am still pissed.
