Apparently not. It would have been good practice to increase the offer until someone else volunteered. They would rather cause a scene and forcibly remove unwilling passengers from a plane that was already boarded.

Most companies settle "nuisance" suits they could win because of time resources and bad publicity involved. And this guy actually has a case.

For me, this just got more interesting. Apparently Tempura was on the phone with his lawyer when the jack booted thugs began wailing on him.

The article did not say how long he was able to speak with his attorney or if the attorney had a chance to advise him before the arse-whooping commenced.

From what I gather, you can still be chosen for IDB after getting on the plane. The issue is the "Must ride" deal that some are posting about, aviation attorneys do not seem to recognize this in a legal sense.

So if it were simply overbooking, yes they could take him off the plane even after he got on the plane, but this was not due to overbooking.
