That's a dumb analogy too. Evictions take place after a hearing. There was no hearing here.

A better analogy is that you sign a lease, pay it, then the landlord tries to evict you by his self, but lies to the cops and says your trying to burn down the house because the tenant after you is paying twice your rent.

Because by not consenting, you're forcing the officer to justify his search. If he can't justify it, you can sue. By consenting you're literally giving up your rights.

You won't find much relief there.

Your fourth and fifth amendment rights are only there if you assert them. If you don't you have no rights.

I just don't get the relevance. A cop busting into my house isn't the same as a cop removing a trespasser from a plane.

If I know I have a legal right to my seat, and that a cop has no legal standing to ask me to move, why should I move? Further, that by voluntarily giving up my seat, I lose my right to further recourse.

Trespassing is ridiculous. Can a tenant be tresspassing by following everything in the lease?
