This whole system has turned into the inquisition, with no due process and automatic guilt. Whoever accuses first is always the victim.

In retrospect the only option for him would have been to report her for reaching down there then performing oral sex when he couldnt legally say no, then turn her into the sexual predator. The whole thing is mind boggling.

I get why someone would question the situation after they were embarrassed and high, but I can't imagine having the gall to pursue the issue through the school's disciplinary avenues.

That's the thing. She's guilty of not asking or receiving consent by admitting it in her story, but she's off the hook because she's female.

He 100% should of flipped the script and accused her of sexual assault. She openly confesses to it. It would have been fun to see what the school's reaction would have been. If he said he was too embarrassed to tell the school and she assaulted him without his consent then even admits to it, I wonder if that would have changed anything.

It's not entirely her fault; she's been brainwashed. She said it herself, her RA training kicked in. She was trained to believe any interaction where she feels uncomfortable - even if those feelings don't arise until days after the encounter - must be assault. This is what the social Marxists have done.

What actually is messed up about this though is that she claimed he sent her a FB friend request after he'd been restricted from doing so. Seems reasonable, except that he denied he'd done that and offered the school full access to his account to prove it but this was not accepted.

But the university agreed he did not pressure her, so you're downvoted anyway.

Like someone else said, these kangaroo courts are 100% geared towards female accusers. The accused can't face the accusers and isn't even allowed legal representation in the proceedings (IIRC). The accused has to represent themselves to prove their innocence. Since they can't face their accuser, they aren't even allowed to cross examine. Being accused is basically a guilty verdict and the schools are forced to implement this by federal pressure.

Well then I would take it to civil court, force her arse to get on stand and tell the whole story then win a big lawsuit from her and the school.

One of the lawyers who works in my lawyer's office does Title IX work. At lunch, he told me that he had a Title IX case where a male student was expelled for having non-consensual sex with a women who had intercourse with him in the "on top" position. He said all the schools, with a few exceptions, automatically assume the woman is telling the truth.

How do you (absent a threat or use of force) have non-consensual sex with the woman in the on top position?



I agree that if the woman wants to quit, she should be able to quit.

The gall came from talking to her RA friends about it imho. She posted the question, and the group think runs from there.

It's ridiculous the disciplinary system would let this story roll through to expelleing a student.
