Remember that many details are often omitted or inaccurate in newspaper articles. I'm betting that the cops knew more than what is stated in the artcile.

Another thing, civil asset forfeiture is not the same as a seizure relative to a drug arrest. They've been charged criminally. If acquitted, they will get the assets back.

A suspect denying a requested search is not probable cause to search.

Once he said no, they cannot make him wait for a dog to arrive.

There was absolutely nothing to suggest they were drug dealers. A drug dog hitting falsely should assure a clean parting of ways, not a robbery.

Will they have the same deputy smiling in the paper when they have to give the money back and cover his attorney fees, plus possibly a civil judgment for violating the couples' civil rights?

A zealous cop does not have as much clout as the SCOTUS.

Assumptions? Are you kidding me? So to hell with due process, guilty in a court of law judged by his or her peers. Nope. Cop has an assumption so they must be guilty.

Was there any evidence that this cash was obtained illegally? Were there any drugs or other illegal items found? If the answer is no, then frick your assumptions. I don't care if it was Walter White in the car, the law exists for a reason.

This is why people don't trust cops. If there's a crime, then do some police work. You don't get to convict people on assumptions.

Rodriguez was a great decision and a nice April treat from SCOTUS.


The decision was issued on 4/21/15...I guess the Justices had a good day prior.

We love to create hot button groups/topics that are just so far beyond questioning that it ends up making them incredibly questionable.

I'd bet that most money has traces of some type of something druggy. It passes through many, many hands, registers, pockets, atms, etc.

There is an actual legal process to size the money. The DA actually goes through an asset forfeiture legal preceding where the person can fight to get the asset back. Most people choose not to fight it in these cases.
