They do not need your permission to settle w/in your limits (unless your policy provides that [Louisiana auto policies do not]).

This right here.

No way that snake in the governor's mansion signs it all but he has basically already said he would sign the prescriptive period part....do that now. He wouldn't sign any of the rest i don't think (certainly not direct action) and I it doesn't feel like the "super-majority" has the appetite to stick it's neck out to override a veto. The rest will have to wait until the state hopefully wakes up in the next governor's election.

I don't know about LA but, here in Fl, I have received a copy of all correspondence between all lawyers and USAA. My wife and USAA are co-defendants in our BS case.

What bean counting insurance company is going to pay for a jury to hear a $7,500 case? $25K, maybe if they are looking at a potential zero verdict.

happens in TX all the time

you get a couple of those and the quantums in the entire district plummet. it's a macro view

But are those cases being tried on quantum or some other issue like liability.

a lot of times it's damages

you get those monthlies from 2500 to 1500 in an entire district and that's a frickton of money over the next few years

well worth spending the money on a couple quick jury trials

Not to mention the "experts" who basically make a living as consultants offering shady information.

I've been a juror on a couple of civil suits and I lost faith in the system.

yes, 100%

now, are there a lot of overly-treated or overly-valued cases? oh yeah tons. but they're not frivolous. the issue is damages

frivolous cases have no liability or value. these cases have value, just a lot lower than what the system allows them to manufacture

Lots of lawyers are lazy and will take a shite offer over going to trial. It’s why companies like Allstate lowball, for better or worse.

This! There are tons of cases that check all the boxes of a tort case, but it comes to greed for damages. The vast majority of cases could be dealt with in the insurance arena or settlement, but many plaintiffs get these attorneys who tell them to go big at trial or the plaintiff has seen enough “X got me $800,000!” commercials.
