Apparently he thinks nobody can ever defend their life if they are sitting in a vehicle.
he wasn't defending his life. he wasn't in danger because the criminal was fleeing.
quote:
Texas Penal Code Section 9.42 requires that all three of the following circumstances exist in order for you be justified in employing deadly force to protect property.
1. You must be justified in using force;
2. Must only be to the degree you reasonably believe deadly force is immediately necessary to prevent:
a. the imminent commission of arson, burglary, robbery, aggravated robbery, theft during the nighttime, or criminal mischief during the nighttime; orb. Someone fleeing from those things; or
3. To the degree that you reasonably believe that
a. The land or property cannot be protected or recovered by any other means, orb. Using a lesser force would expose you or someone else to the substantial risk of death or serious bodily injury.
it will be hard to argue that using lesser force wouldve exposed him or someone else to substantial risk from a fleeing criminal and that there was no other means he couldve employed to recover the vehicle, such as calling the cops while in pursuit
I'm glad the thief got killed, but we can't have citizens driving down the street shooting at people legally. that is a danger to innocent bystanders. if you make it legal, then folks with shitty aim can do it also.
if you are sitting outside and see a car driving down the road shooting at someone and bullets are flying, i'm sure your first thought will be, "wait a second, this might be legal, the guy in the other car may have stole his car."

That guy may have worked years to earn that car. You dont have the right to dictate what thats worth to him.
Shoot enough of them, they'll cut this shite out.

You realize in 2007 Joe Horn shot two men in the back, as they fled his neighbor's house, stealing household items, after the 911 operator told him not to?

And onto his property... that sort of changes things a bit.

isn't this the reason we have police? You can't chase someone down and shoot them. This is like basic knowledge. There is one occasion you can shoot someone - when they try to break into your home, and even that's going to cause you some headaches. And they better be inside when the cops show up

Legal or not, Harris county brought this on itself.
The sheriff is under investigation for over a quarter million uninvestigated crimes and there is a revolving door for felons in the cases that do make it to trial.
The only way to protect your home or family in the Houston area is with a mag-dump, certainly not a call to 911.

So you think the victim of theft is more deserving of being shot than the thief? Says everything anyone needs to know about you.

The explosion in criminality is going to lead to more vigilante action and a lot of jury nullification.
Biden and the Democrats tell me that crime is down substantially pretty much everywhere since he took office.

One less POS criminal on the streets, and he saved the taxpayers a ton of money not having to pay his slimy defense lawyers and to house him in prison.
I would say the guy deserves a medal, or at least a cookie.

i'd say so also, but shooting a firearm while operating a vehicle is dangerous AF unless you are John Wick or Jason Bourne. I'd need to see footage tho, maybe he was extra careful about it and there was no danger to any bystanders

I ain't losing sleep that a thief is dead... but once he left the property, there was no longer an imminent threat. Dude is screwed.
Y'all keep posting stuff like this. There is no element to this pertaining to an imminent threat. The relevant law is:
quote:
Penal Code Section 9.42
Deadly Force to Protect Property
Deadly force to PROTECT PROPERTY. This has nothing to do with self-defense, the thief being a threat, etc.
The only part that, in any way, deals with danger to the property owner is his reasonable belief that using force other than deadly force, to protect or recover the property, would place him at risk of a minimum of serious bodily injury.
This statute is explicitly written with regard to property crimes. Use of Force/Deadly Force in Defense of Person is an entirely different statute and deals with crimes against a person (sexual assault, kidnapping, robbery, murder, etc.).
But hey, keep talking out of your asses...

know it’s cool to be on the internet and say this is acceptabe, but in no way is it ok to chase someone down and open fire into the vehicle in any sort of decent society.
Bunch of TD Hardos advocating for chasing someone down and mudering them for theft. I hope you try this and get shot.
I don't think he should have shot to kill him either. I think he should have maimed him and burned the POS alive. You are a POS also for defending the thief. I hope you get robbed and lose all of your shite and never get it back.
Anyone that thinks like you deserves to have everything taken away from them.

The kind of case where the cops might have to arrest him but a decent DA would make sure the grand jury does not indict
But this is Harris county so they’ll probably want to punish this guy
