Teen in stolen car outside Gentilly restaurant shot by vehicle's owner; owner jailed

A teenager sitting in a stolen car parked outside a restaurant in Gentilly late Monday was confronted by the vehicle’s owner and shot in the chest, according to New Orleans police.
Terrance Johnson, 45, faces a count of aggravated second-degree battery in the shooting of the 17-year-old youth, who remained hospitalized Tuesday.
It was not clear whether New Orleans police would book the teenager with a crime, such as illegal possession of a stolen auto. But the St. Bernard Parish Sheriff's Office issued a statement saying he was wanted on a count of vehicle burglary and theft of a firearm following a series of car break-ins in Arabi a few hours before he was shot. According to police, surveillance video from the Waffle House in the 4600 block of Old Gentilly Road showed Johnson walking across the restaurant’s parking lot to his car. He pulled out a pistol and began arguing with the 17-year-old, who got out of the car, police said Johnson and the boy then began fighting outside the vehicle, and the boy was shot in the right side of his chest. Johnson waited until police arrived and was ultimately booked.
Paramedics took the teen to the hospital. His condition wasn’t available Tuesday. Damn

Asked to analyze the case, defense attorney Craig Mordock said there are laws in Louisiana which allow people to use deadly force against anyone intruding on their personal property. But, based on the details in court records, those laws don’t appear to apply in this case because the teenager who was shot had been in the car at a time when Johnson was not in it.
Mordock said Johnson should have called police and given them a chance to recover the vehicle for him.
“The law doesn’t allow you to just shoot someone" for being in your car, he said.

Sounds like he got shot while fighting the owner outside the vehicle, not for sitting in it.

That's dumb. If somebody steals my car, I'm not going to make accommodations for their well being in recovering it.

There SHOULD not be a jury in America that would convict the shooter in this case. I sure as hell wouldn’t.

The way I see it, when you steal someone’s property, especially their vehicle (which they need for their livelihood) you are stealing little bits of their life.
We sacrifice our time (I.e., our lives) to acquire our property. The time I spend working to afford my property is time I don’t have with my family, my kids, doing things i like to do. But I do them so I can have nice things. You sacrifice a lot of your time to afford big purchases. Therefore when you try to take away my conveyance, which I need to maintain my family’s livelihood, you are taking bits of my life. And all bets are off.

This is bullshite. He didn’t shoot the kid while he was sitting in the car. He shot him after they got in a fight. A police officer would have likely shot the kid in the same circumstances.

Article is clearly trying to paint the car thief as a victim rather than a neutral or antagonistic party.
"Youth" is an accurate assessment, but "boy" likely isn't.

I understand using a weapon when one's life is endangered and the shooter's wasn't. However, the logic stated for why charging doesn't make a lick of sense

Considering that the police are under no obligation to show up, and in some areas like Monroe are notorious for not wanting to show up and handle property crimes regardless of whether you can lead them straight to the perp and the item, this is a problem.
