Wondering if shoplifting a beer is cause to get shot? Doesn't sound like the victim attacked the clerk. He's fricked.

There aren't many states where deadly force is allowed to protect property. Texas is one, but obviously Tennessee isn't.

When I was 4 I was too shy to pay for gum that I had been given money to purchase so I just took it. Lucky I didn’t grow up In TX!

We always threw a ten dollar bill down on the counter when wahooing beer, which would cover the 12 pack. Less of a chance of the cops getting called (and come to find out, getting shot).

Seems difficult to prove premeditation as defined in Tennessee:
quote:

As used in subdivision (a)(1), “premeditation” is an act done after the exercise of reflection and judgment. “Premeditation” means that the intent to kill must have been formed prior to the act itself. It is not necessary that the purpose to kill pre-exist in the mind of the accused for any definite period of time. The mental state of the accused at the time the accused allegedly decided to kill must be carefully considered in order to determine whether the accused was sufficiently free from excitement and passion as to be capable of premeditation.

Should your boss be able to shoot you for spending 15 minutes on Tigerdropping while at work? That'd probably be stealing more of value than a beer.

Shooting someone who is fleeing is a big no no wherever you are.

To think this clerk may have saved an innocent life. This teenager could have drank this beer and my have had drugs in his system and then could have gotten behind the wheel of a car and hit someone head on killing an innocent life.

Hope charges don't stick.
