Itbdepends on the evidence. Has the clerk in the past threatened to kill people? Has his interactions or discussions in the past let people know that he was looking for an excuse to kill someone?

First, I'm pretty sure he can't follow him out of the store and shoot him while he's fleeing. Even policemen are forbidden from doing this.
Secondly, unless the store clerk's life is in danger, I don't think he's allowed to use deadly force?

EVen worse, the frickups who take lunch breaks. That’s an hour during the middle of the day where work isn’t getting done.

Ya’ll think Dorian drank the beer before he died? Shot in the thigh and bled out. Yikes that had to suck. Two thing. 1. Frick this guy for shooting a dude over a beer. 2. Unlikely anyone tries to shop lift a $1.50 beer from them in the near future

When I first started practicing, I defended a store clerk who had beat up a shoplifter. He was charged with a misdemeanor and it clearly wasn't self-defense.

The victim had a huge string of shoplifting and theft arrests.

He said he just snapped - tired of all the thieves that come in and steal.

Texas jury walked him.

ETA: This wouldn't happen in Louisiana, even if we had jurors on misdeameanor cases. We have too many jurors who really don't have a problem with stealing.

To a certain extent. If a suspect is armed and fleeing the officer thinks it likely that the suspect will cause immediate violence to others in the vicinity, depending on the state, they can use judgement in dealing with situation

I agree with both points. Yes, shoplifting/stealing is bad but shooting him over it was not justified.

True but the employee wasn't a cop and there is no way he could no if he was going to cause immediate violence to others.

Make the offense for stealing harsh and this isn't as likely to happen.

Yep, I agree this guy fricked up. Just wanted to point out the difference and it’s definitely a sticky difference but to use lethal force, an officer has to believe they themselves or members of the public are in danger, lethally or other extreme violence.

If I had to guess, he was probably just trying to send a scare mess: "if you try to steal here, we will come after you." Sucks for him that it actually hit him.

And yes, if the person is running away, you shouldn't be shooting at them. It's sucks, but it's the way the laws work.
