Starting a Law Firm

Do you need to be a lawyer to start a law firm? Seems like anyone could do the "Morris Bart model". Own the firm and manage it, hire a bunch of attorney's and let them do all of the work only a lawyer is supposed to do. You as the owner can concentrate on marketing and management.

Seem like some businessman would have don this already.

By law, only lawyers can be owners of law firms

Even Morris Bart keeps his license active. He only manages the firm and probably doesnt know where any courthouses are anymore, but he's still got an active law license.

No idea, but it seems like a good idea. My aunt runs a small town law firm and it's ridiculous how bad she is with money. I can't believe she is still afloat.

I think all states specifically prohibit this and the Rules of Professional Conduct for Lawyers (adopted my most states) prohibit it, as well.

Yes. Non-lawyers cannot own a law firm. In fact, when a lawyer is disbarred, he is forced to sell his practice. E Eric Guirard’s firm became Dudley Debosier when his licenses was suspended. In addition, if a lawyer who owns a firm dies and none of his heirs are lawyers, his estate has to sell the firm. He cannot pass down even a 1% ownership share to a non-lawyer.

I think Arizona allows it now. Most require at least joint lawyer/non-lawyer ownership.

A PA or NP can own a medical practice.

That's correct, at least in LA. Non-lawyers cannot have an ownership/equity stake in law firms. However, they can hold leadership positions (i.e., CFO, COO, CMO, etc.).

You have to be a lawyer to own a law firm, but I know plenty non-doctors who own medical clinics.

I think you can own a stake in a law firm without being a lawyer in DC.

Some IT guy working for a major Houston law firm embezzled them into bankruptcy a few years ago. They didn't have even the most basic accounting controls in place.
