Brian Banks came out today with a statement about this case. I can imagine his blood is boiling.

Sidenote: Didn't come out that the judge is affiliated with the Stanford athletic department in some way or is that just a rumor?

If not, then it does make some sense, but still not sure it warrants a new judge just because he went to the same school as the accused.

Yes. Never with someone who was unconscious and never with someone random and drunk. It's simply not worth risking it in a borderline situation, so consent had to be unequivocal.
This argument that both are drunk so both are culpable is nuts. Getting drunk and raped is NOT your fault. Getting drunk and raping someone is your fault. Cut and dry.

People try to justify the actions of terrible people behind the guise of "personal accountability."
We can have that conversation, but the second it takes away from the responsibility of the person who actually committed the damn rape, it's gone too far.

This...it is pretty deplorable what this girl and her family went through. I'm telling you right now if I was any man in her life that cared about her (boyfriend, brother, father, uncle, etc) I'd probably have killed that swimmer at least 2-3 times by now and probably his dad too. Too claim that what happened to her was OK because they were both drunk is probably the most reprehensible thing I've ever heard a human say and this prick's dad continues to say it.

The actual undeniable truth is that you can't.
Any of the girls that you were with in your life can wake up tomorrow & acuse you of rape. Hell, they could even still have the panties or some soiled article of clothing from that night. They can get a friend to submit a statement that they heard her deny you &/or tell you to stop. But they never came forward for any number of reasons.
The fact of the matter is that we've reached a DANGEROUS point where women have all of the control over the back end of any sexual encounter, consentual or rape.
On top of that, I know plenty of people who got hammered drunk, banged it out, have no recollection, ended up pregnant, & now are parents.
Prove to me that it wasn't rape.
You can't without HER testimony, maybe some bruising, or somehow a witness or sex tape/audio of a "No/Stop".
How many times have you seen/heard the situation of 2 people waking up after a "wild night" with the question of "Did we do it?" & yet the only answer is yes. No proof of a failure to secure consent...so, was it rape?
We've gotten to a point where a guy needs to have an audio recording or a girl giving consent, signing a document, & even following up with recording post-coitous to prove without a doubt that the sex was consentual. Otherwise, you're guilty until proven innocent. Life ruined either way.
DO NOT GO CRAZY WITH A FURIOUS REPLY. I AM NOT DEFENDING RAPE OF ANY KIND, MERELY POINTING OUT SOME BAD GRAY AREAS.

Horrible logic. Protecting one person doesn't mean you intend harm on another.

It's called a preventative measure and we take them every day. Not passing out behind a dumpster is a preventative measure.

It's a kind of thinking that is well intentioned and idealistic but still incredibly naive and gullible as hell that refuses to account for the evil and predatory side of human nature. With that said, I know for a fact that the judge fricked up here and the rapist should've been put away for goddamn life and required to pay restitution to the victim. I hope the judge gets recalled and the margin isn't even close. frick that judge and frick the POS rapist. From what I've read of the victim statement, it seems like she's a capable woman that can and will pull herself through this. Good luck to her.
