But, he claims she consented, that she even initiated. She admits that she was so drunk she doesn't even remember the interaction at all.
I'm struggling now to lean towards her defense. I've been in situations where drunk girls have come on to me, stripping my pants off, then not remembering it the next day.
He may be telling the truth. I slightly lean towards him not, but I know she can't give us an accurate desciption of the incident.
It is a tough case.

Yeah, in fairness I don't disagree with your take regarding the specific facts of this particular case that weren't addressed in the OP. But that isn't what I was addressing in this thread. There are some posters here who are either trolling or are justifying that raping a passed out chick is ok because the girl needs to make sure she's sober enough not to get raped.

It's really not all that tough at all. Theorize she consented at one point. At whatever point it was that she became unconscious, you stop everything and take care of her. That's what decent people do. You don't hump and finger her. It isn't that complicated. If you're brave enough, read her statement.
