I'm not going to use a legal word of what happened at the store because that's meaningless. But the physical confrontation in and of itself does not justify the shooting. You would be correct. BUT...it does have to be taken into consideration when looking at the shooting and will have an impact/effect on how that shooting is viewed.

If you are shoplifting and then are caught that is shoplifting.
If you are shoplifting and the owner catches you and then you use violence or the threat of violence to flee with the goods then that is robbery.
If you drop the goods and run you could only be charged with attempted simple theft.

Cant stress this part enough. There is case law out there where officers have shot suspects that had a size advantage on them and ultimately started losing the upper hand when trying to make an arrest. It also explains why the officer got out of the patrol car with gun drawn.

WTF? Of course not. Maybe I'm unclear what physical confrontation he's talking about because I took that to mean the confrontation between MB and the cop.
