THIS EXACT scenario happened after a family member, on my policy, bumped a car on Nicholson. Insurance attorney said they were going to "pay her to go away" and I pitched a major fit and demanded they fight the suit under threat of pulling my corporate business from the insurer. They ended up going to trial and we didn't even have to put on a case. Judge ruled for us after the plaintiff's witnesses lied all over themselves. Plaintiff was also ordered to pay our attorney's fees since they declined a settlement offer earlier in the process (frickers didn't tell me they tried to settle). It was the most satisfying day I have had in a long time.

I would bet the dickbag lawyer. why don't you let me know what number to call to get in touch with you. If I ever get rear ended in the slightest, I'll be sure to give you a call that way I can get a higher share of the easy as pie $25k or $50k that is handed out every day in this state.

There is an entire economy of judges, bailiffs, attorneys, chiropractors, private investigators, pharma, pain "docs" etc. on one side...
and multi - billion dollar insurance companies on the other side.
The only ones getting screwed are the people who are not in on the game.
Move the jury threshold to $5K, insurance premiums won't change an iota, courts will be strangled and PI attorneys might make less. It's a zero sum game - they are going to figure out a way to exact money from the economy somehow. Not that it's right, moral or just. It is not, not in my view.
The ones who really make out like bandits are chiropractors and others who provide services to the soft tissue "victims."

That ain't happening, ever. Juries, would, of course, put a stop to that nonsense. Of course, the elephant in the room is that litigation is good for plaintiffs lawyers and defense lawyers. Neither want the jury trial limit lowered because it would result in a lot less business for both.
