Call the DA and see if you can get it knocked down to a non-moving violation and just pay the fine. I think they do that as a matter of course in St. Charles.

This is a common misconception I see on this board all the time. For one, you’ll never hear from the DA (unless you know someone), but, most likely an ADA. Both of whom couldn’t care less about the money going to the state. It’s not like they’re pocketing your fine.

They will, however, try and help you out by suggesting using your article 894 privilege afforded to you by the state. I wouldn’t suggest using this because it can be used for a felony or misdemeanor traffic charge (save it for when you need it).

As previously stated in the thread, just because you got a speeding ticket, your insurance company isn’t going to hike up costs unless you try and buy more insurance. Keep it clean for about 3 years and they will never know.

I really don’t care about how much the ticket will cost. Can I tell the DA over the phone I don’t want to plead not guilty and ask for a non moving violation?

Fight the ticket, I'm surprised St Charles parish is still running this scam since Lee Zurik's exposed the racket. Yes, they just want your money and St Charles parish is splitting the proceeds with the State Police.

The trooper who gave you the ticket just woke up from a nap at his house while on "special duty" patrolling that same stretch of road.

Nope. That’s not how it works.

Your license number is gonna hit you dealing with your insurance. Your insurance goes off what’s on your driving record

In St. Charles Parish, if you call the number on the ticket and let them know you want to plead guilty but you don't want it on your record, they will do it over the phone. It's a money grab.

I agree with you that in other jurisdictions you generally cannot speak with a DA, but in most, if you show up you get to pre-try the case and talk to an ADA who has decision making authority. If you have a generally clean record, in most circumstances, they will let you plead to a non-moving violation.

Just let them know you do not want it to go on your insurance. They will tell you how much you owe. Send the money in and they will not report it.

Why would the Parish DA go out of his way to do something (of he can) about a state issued citation?

The DA doesn't care. It's done by the receptionist or whoever works the phone. It's different than almost every other parish but that's what they do. Pay the ticket, it goes away.

Just call and tell them you want to pay the ticket, but don't want it on your insurance. They'll know what to do. IIRC, you make the money order payable to the sheriff in St Charles Parish.

Eta: Just saw 81 in a 60. They might want you to go to court on that one since it's 20+ over. I can't remember the last one I got

Your insurance information can be found when he runs your license. Had this explained to me when I was pulled over a while back.

Years ago it took 3 tickets to be high risk.

Is that still true?

Personally I think tickets should be permanently on your.

Also I think bad credit should be permanent, too.

Why you asking a bunch of message board folks??? Call up your insurance company, and asked them how best to handle. Thats why they have that toll free#...

Whats article 894 privileges?

And...

Some companies look back 5 yrs not just 3. Within 3 is worse, and more prominent, and a bigger piece of the rate. Those last 2 yrs arent as much, but still factored into their algorithms. Smaller price drop at the 5 yr mark as it starts to dwindle little by little after 3yrs.

Ins companies just run your reports the first time, and as long as they dont catch wind of accidents then you should be good, but not always guaranteed. Unless you just have bad luck, and some kind of internal audit is happening. Chances are small. Until you ask for a big change you shouldnt have an issue, so make sure you dont call on a whim.

Ohhhh and make sure your kid doesnt call them for a scratch on the car like that Allstate commercial where the parents were reading in bed. Assess things first, and dont self report just because you "are wondering". At fault or not it's recorded. Obviously major ones is a different story.

Louisiana Code of Criminal Procedure Article 893 / 894 If you have been charged with a felony or misdemeanor for the first time in Louisiana, you should ask your attorney to enter any guilty plea under Article 893 or 894 of the Louisiana Code of Criminal Procedure. Article 893 is for felony pleas and 894 is for misdemeanor pleas. The advantage of the 893 / 894 plea is that the conviction is never entered on your record. If you follow all the conditions of your sentence, you will be granted the opportunity to expunge the arrest.

You can’t have a misdemeanor 5 years before to use that option.
I think it’s a one and done for a felony charge.
