Some asshat in a flatbed truck scuffed down the side of my new Mustang, knocking off the side mirror and even scraping the back rim. Luckily, someone had seen him (small town, so they knew him) and he left a note on my windshield with his insurance info.

I had a cop come out and write a report for my insurance claim (on his insurance). I called my insurance company and they handled everything (he refused to answer calls from his own insurance company, but because I had his note and the police report, his company finally just paid for all my work with no fuss... other than having to wait a month or so for them to realize he was hiding from them).

Call your insurance company and let them know you have the police report handy. If you've got his insurance info (if he has it), make sure you let your insurance company know.

Assuming he was arrested for either DUI or hit and run, ask the ADA handling that matter to make him pay restitution through the criminal process.

You won’t collect from him. But if you had Uninsured Motorist Coverage you would have a cinch claim.


Buy all of it that they will write you. ( usually your liabilities limit ). It’s the coverage you wil. most likely use in Louisiana.

If it was indeed an Illegal Immigrant you will get nothing and even worse nothing will happen to him legally. We don’t even know who these people are or where they come from. Most of them have like five aliases that they rotate. Examples:

Jose Rodriguez
Jose Maria Rodriguez
Jose Rodriguez Maria
Jose Maria Rodriguez Ochoa
Jose Ochoa Rodriguez

They have ‘identification’ for all of them and just rotate. Had a police officer explain this to me once and it’s why it’s so hard to keep up with them in legal and court system.

Call me small and petty but I would make his life miserable. I might not recover anything for it but I would get a judgment against him. I would follow him to whatever shite job he worked and shite place he lived.
If the result is he leaves town, well you’ve done something good for your community.

It takes a bit of waking up once you see the amount of uncivilized living among us civilized people. Start looking at all the cars missing license plates. You KNOW there is no registration, no insurance, probably no driver's license and yet I've seen many just tootling around without a care in the world. Driving right past cops, in front of cops, all around cops. I've yet to see one get pulled over.

So you're seeing more and more look at the Huge increases in insurance and the idea of skipping out of paying tax on that car they purchased and deciding to print out their own temp tag and let it ride. Most of the times it's only the willing to be governed that end up being punished. These others just continue getting their govt hand outs and might do a little time if caught, but it's nothing. And we'll all pay for it. Twice if we're unlucky and get nailed by one of these drunk idiots.

The appropriate response would be to allow you to enslave them for a set period of time to make restitution. But the law is more on their side than the law abiding. Which is why this is growing exponentially. Good luck getting anything other than a bill to fix it.

5 years ago I was coasting down the left turn lane up to the red traffic light at about 10 mph when a small black flash went across the front of my company Ram pickup. It was a black Ford Focus that drug across the front left side of my company truck. Well I came to a complete stop and got out to survey the damage. That car broke the headlight and dented the fender but did not set off the airbag. Looked around for the Ford focus but it was gone like a puff of smoke. So I called the brpd to make a report and told the dispatcher that it was a hit and run and then pulled off into a side street to wait for the police. The police came to get my statement and paperwork and at that time (about 20 minutes later) the black Ford focus pulled up (the driver's side was all caved in) and the police attempted to get his paper work. No license and no insurance, he was from Nigeria attending SU.
I drive away back to our office and my boss scheduled a repair for my truck.
About a month later I got a called from the Nigerian guy's lawyer, who was his sister, wanting me to change my statement on the police report ! Of course I said no. Some people are just too corrupt.

Back in the 90's two messicans killed a couple and their child running a red light around here. No license, no nothing. Terrible.

the wife and I got hit in her passenger door by a non English speaking person. had no license and no insurance. all he could say in English was please - no papers.

door closes, window cant roll down anymore and the door caved in from the outside.

since he had no insurance, and I found out too late ours doesn't either, he paid 500 bucks out of pocket - bought a new fridge and dishwasher with it.

after he hit us, he looked at us and drove off - I followed him to the next light and forced him to pull over.

Happened to me once and I got nothing. Drunk dude in a sedan. Got his plates. I was about three hours from home. The police found his car with a bottle of booze in the back. They told me I could show up and press charges, but I would probably not get anything.

Sure, if he's working on the books. It will cost you though. Both in terms of time and money, unless you're willing to do all the filings yourself, then it will cost you much more time. I'm not sure if it would be worth it if your losses are minimal.

He’s going to be in the wind soon, if he isn’t already. Probably will slip back across the border for a while then come back across and settle down in some other part of the country where he’ll most likely once again get drunk and cause a wreck. The only question is will it be like what happens to you or will someone end up dead next time.
