NOPD never denied the existence of a second gun, they just didn't answer the question. And people seem to be confusing when the existence of the second gun was revealed as the date on which the warrant was executed. It wasn't.

This only matters if Smith would have been killed as a result of bodily injuries from a vehicle accident. The shooting was a sign of aggression. SMITH WAS SHOT TO DEATH!!!

Actually, the story was that Haye's weapon was the only weapon confiscated from the scene.

LINK

What date was the warrant executed and was the gun found on that date?

I don't know what date is found other than that it wasn't found at the scene.

What's your gut as to what will happen with the case?

They didn't confiscate anything other than one gun on the scene, as they towed the cars and executed the warrants there. Didn't necessarily need it, but better safe than sorry. People have just been assuming that the gun was found on the day they told the public because Fuller is grandstanding.

No idea at all, the reports haven't even been written. I can tell you that for those of us who have tried cases against Fuller, "the media convicted my client on day one," "look what they've been hiding from us," "you'll be shocked once the facts come out" are all too familiar.

Yes, but much more so on gun/drug cases than in cases with victims.

Only one went to jury decision instead of pleading out after picking or right before the jury got it. He beat me in a bench trial.

Pleas aren't necessarily a loss for the defendant. Look at what fuller managed for Hayes. Ike pled him to the 95e, fuller came in and had it withdrawn and got two misdemeanors. Huge difference in many ways, including the fact that if the former had happened, the story right now would be, "well he's definitely in prison for at least 10-15 for felon with a firearm."

yep. hayes would have no defense.

how much do you think will smith being shot in the back factors in to the self defense thing?

also, what are your thoughts on a jury trial in new orleans? which do you think will drive the jury? will smith being a saints player vs fuller obviously pushing the corrupt nopd.

Has Fuller insinuated the NOPD was corrupt in this case? I thought it was just the former NOPD captain.

I think he purposefully left the insinuation open ended knowing that many will be quick to assume NOPD corruption given its history.
