I think it could. It depends on what a jury believes his intent to be when giving chase. Was he following too close in an attempt to intimidate Smith? To crash into Smith as retaliation? Or was he chasing just to get a license plate number? Or to make an attempt at some point to flag him down?

Agreed. Of course, that may not matter much depending on the facts thereafter and what's on the mysterious video allegedly being held by NOPD.

Yea I don't think the case will turn on Hayes' intent when giving chase. What happened after the crash is much more important.

I hope the preliminary hearing goes on as scheduled and isn't derailed by an indictment.

What's this stuff about Hayes having Five lawsuits already from people rear ending him? Looks like that initial brake check may have been an insurance scam.

There was no brake check. Unless stopping because there are cars in front of you is a brake check

doesn't a 2014 G63 have crash avoidance? I would think the suv would have hit it
s brakes and stopped the car. He did hit, but it was a mild impact, nothing like the second impact, and nothing so far that justifies bullets in the BACK. Unless I see evidence that Will had a gun, this was murder, plain and simple.

So we can see a garbage can and a car directly in front of the hummer in the parking lane.

Are you saying Haynes slammed on his brakes on the middle of Magazine street because he saw a car and a trashcan on the side of the road? I'm assuming that's not what you meant but just want to be sure.

No, that was the reason he didn't pull completely to the side after being hit.

thanks, interesting, it's not as proactive as the system Volvo and Subaru use then. It requires braking first to activate.

Still in all, I have been in plenty of wrecks, never once did someone get shot.

Oh okay well has there been any reason put out as to why he locked up his brakes in the middle of Magazine with nothing in front of him? Saw a parking spot he had to have?

To be fair, the Aiden Gil camera does show a car at least a car length in front of him, he had to stop, but he stopped hard. If he really does have multiple Traffic accidents rear end lawsuits, then I don't doubt he saw a Benz and thought payday.
I used to know a lot of people like that.

It has assisted braking, but not something that will detect a crash and stop without human input. At least according to the Mercedes website.

No because he didn't lock up his brakes and there were several cars in front of him when he began to slow down.

It was a mildly aggressive stop imo. Not a textbook stop, but absolutely not unreasonably quick. His distance was about a car length from the one in front of him, maybe a little less.

Additional cameras show cars stopped ahead of him at the light. If you saw the video, it's VERY evident that he didnt

I'm sure Pierre would be Subpoena in the trial, he was a witness.
