This scenario happened to a client of mine. He tried to "let it go away" at first before figuring out just how crazy this lady was. She called and he apologized for "anything that might have happened" because he thought that might get her to go away. The police were recording the call and the DA said his apology was equal to an admission of guilt. They indicted him and were ready to go to trial. His attorney got a plea deal that involved no jail time but he has to register as a sex offender. Scary stuff.
FWIW, he and the girl were black out drunk. There were people in the room (on another couch) when they were bumping and the girl never once said stop, don't or anything else. But the fact that she was drunk was enough for this guy to almost go to jail.

False. Her word was enough for him to almost go to jail, drunk or not. You can consent when you are blackout drunk, which just mean you don't remember what happened during that time. But during that time you are able to function and talk, it's why being black out drunk doesn't absolve anyone from crimes they commit.
