I have no problem with the permanent checkpoints which is what was ruled on in Fuente. I understand the reasoning for Mobile Patrols. I do not like tactical checkpoints, because typically this is where some agents are alleged to be more "rogue" with their questioning and tactics (which is illegal). If you're arguing the original decision and standards and laws set-forth are unconstitutional I wholeheartedly disagree. If you want to argue that the overstepping and attempts to broaden authority not expressly given or even ones forbidden as your reasoning then I agree that infringes, but that's not what the original discussion was. The original discussion was that the stops were unconstitutional which they aren't. Now are there constitutional infringements made by agents at these stops when they go beyond what they are allowed to do by law? Absolutely
Good post and succinctly summarizes the issue.

You do realize that the wall would stretch from the Gulf to the Pacific whereas the Maginot just ended on land? Pretty damn big difference.
You do realize Messicans know how to build boats?

Should have told her she could stay in Mexico until she answered the questions and produced a passport.

There's a nice and clean solution to border patrol checkpoints: build the wall.
HAHAHA. Yes no one will build tunnels underneath or climb over a wall. Cartels will likely start knocking sections down. The Maginot Line will likely be more successful than a border wall.
No to mention Trump already said the wall needs to have holes in it so we can see people throwing drugs over it...or, you know, passing them through the holes.

I don't even think the Border Patrol is allowed to require you to hand over "papers" proving citizenship. I think they're only allowed to ask.
That is dumb as hell if true.

They just ask and do a quick exterior visual inspection of the car.
Now, I don't know how easy it is for them to pull you over to secondary inspections though.
These interior checkpoints are all documented, listed on Wikipedia, and on Google Maps.

why would border patrol be looking for drugs 300 miles from the border?
Wait, do you think that there is no international border if there's not another country on the other side of it?
Lake Charles is less than 50 miles from the border. Pretty much all of Louisiana South of Alexandria lies within 100 miles of the U.S. border.

What exactly are they looking at while sitting on I-10? Cars and buses with Mexican tags? IF that is the case they are over 400 miles away from where they crossed the border.

I was responding to your assertion that Lake Charles is over 300 miles from the border. Man, those goalposts sure are speedy.

I went through a BP checkpoint in AZ with a Canadian guy I was working with and he was freaking out because his papers were in the back with his bags. I told him, "You're white, so just tell them you're American. Just make sure you don't say the word 'about'."
Worked like a charm.

Yeah, I gotta agree with her here. Most people here love the second amendment but I'm a much bigger fan of the fourth. I hate Terry stops and my biggest professional goal is to take a case to the Supreme Court to overturn K9's being used to establish probable cause for a vehicle search
I can only surmise by the amount of votes on this post without a response that there are a hefty amount of people who have no idea what you're talking about or why it is important.

True. I've been through plenty of checkpoints in areas where there's a wall in place and seen bricks of drugs lined up outside a car that went through the checkpoint.

The wall is already "see through"

.. I still agree with the agents , and to me it isn't a lot different that being asked for license and registration; except the consequences of getting caught if she was an illegal alien
Except its their burden to prove you arent a citizen. Remaining silent is the right of every American Citizen. I'm curious what reasonable suspicion they had to detain her for. "Looking like an alien" isnt RS.

The OT isnt a fan of asserting your rights. They'd rather waive all rights without a fuss to make sure the officer/agent has a good day.
"Just do what they say and no one gets hurt" -the OT.

Its always interesting when people find out the BP has jurisdiction within 100 of ALL borders, land and water.

Yeah, that is an attention seeker. Not sure why people won't answer a simple question, especially when they know that will let them pass. Morons.
I wouldn't do it because I'm lazy and usually just try to get along but I'm glad there are people out there who don't mind going out of there way to challenge the ever-growing power of the federal government. What's the point of having a right if no one ever exercises it? And bottom line, she has a point, no matter how annoying it may be.

If they included international airports as was mentioned they're trying to do, there would hardly be any land left that isn't, if any.
It's not funny but just so ridiculous you have to laugh.
