Thanks. I will say with casing being in Gasser's car, that the state must have some crazy evidence to make a case with.

My understanding is that they were both aggressively pursuing each other. Better witness testimony and additional video footage seemed to confirm this in the days after the incident.

Additionally, I believe they can still return a guilty verdict on the lesser manslaughter charge even if they are not able to convict on the murder 2 charge.

That, and the fact Gassers car is in a proper lane, while Mcknights car is off to the side, make the case seem very difficult for the state IMHO

2nd degree murder seems tough but that's my opinion without knowing a stitch of evidence. Manslaughter seems like it would fit but again that's not based on any fact but merely what the paper put out.

Do you have the right to shoot someone if you push them to the point of breaking? I think prosecution brings up many character witnesses and paints Gasser as the violent, hot tempered driver. More than likely will claim he was the aggressor in the driving and altercation (knowing he had a loaded gun the whole time hoping to get McKnight to approach him so that he could shoot him). That is what will be the deciding factor....did his actions purposely entice McKnight so that he could shoot him. That's the only way I see 2nd degree even being an option but even still it sounds more like manslaughter.

Even if the prosecution is seeking a 2nd degree murder conviction, the jury can find him guilty of manslaughter.

I can only assume the state could also figure that out, and wouldn't make charges like that without at least something decent to back them up. Should be an interesting trial.

So if the casings were in the gunmans car, then he was in his car when she shot the weapon.

We know the statements about gunman shooting him and touting his kill was BS.


People need to really read about the castle doctrine laws in their state. There have been 2 cases in Missouri, where some one shot at the car thief as he pulled away from scene, both killed as they drove off. the DA in both cases is going after the shooter, not allowing it under the doctrine.

And while one of them is sure to get off the charges, because the jury will be very conservative and pro nra, the other could be fricked.

I'm not putting my life in the hands of some retards on a jury, so you better make 100%, ur kill is good.

He chased Gasser for 5 miles(video evidence will prove this)
he blocked Gasser in at a red light
He exited his vehicle and was shot from inside the car standing next to Gassers car


thats enough for me if im on the jury

Not exactly. You must have a reasonable belief that your life is in imminent danger or that you will suffer great bodily harm.

So, if you truly believe it, and it is reasonable to believe that will happen, you're likely clear.

this has nothing to do with castle doctrine, the threat was over.. in these cases, from what you said, the shooter turned into the aggressor the moment the robber moved away from the scene.
