I know it's a fun, popular joke, but attorneys routinely get lengthy suspensions for merely "commingling" funds, i.e. not properly keeping their operating and trust accounts separate, even if the money was never taken. On the other hand, "conversion of client funds", or improperly taking the money from the client, routinely results in permanent disbarment.

According to his public bio, he graduated from UNO in 1975. Assuming a relatively normal age of 22 at college graduation, that would have him right around 70 now.

Unless you're trying to say that E. Eric Guirard was never suspended or disbarred, and then I'm going to be even more confused than you appear to be.

I may have been confused about who I was responding to. Morris Bart has not been suspended from the practice of law.

No worries. Guy I responded to said that MB had been disbarred. I said I didn't think that was accurate. He replied that he was confusing MB with EEG, and I replied that he had definitely been either disbarred or suspended (now that I've looked it up, I've confirmed disbarred). But the posts were short and clipped, so I could see how it might be confusing to see them out of order

As a claims manager for a large marine company, we got sued by every deckhand with a broken fingernail. I always breathed a sigh of relief if MB was repping them. You knew they were never going to trial, the lawyers working there were bottom of the barrel, settling was always low and easy.
So don't expect the DA's office to get more aggressive.

"The lawyers working there"> MB was well known for using paralegals & insurance adjusters to work the cases. When it came time to seriously talk money, one of his low paid minions would step in. He was also well known for leaving a business card clipped to a dollar bill for tips.

If I had to guess, the DA's office is going to send them a review checklist. Anything that meets the checklist gets the prescribed action. Anything that doesn't meet the checklist gets referred back to the DA's office. I very seriously doubt they will have any kind of executive decision making authority.
