Entertainment was taken from the performer. He was entertained enough to take a picture and he should give the guy a buck for that. While he is not required to do so, he also isnt protected from being yelled at.

From OP, and I must say it sounds like the dude needs to work on improving his craft. Plus he lost a bunch of other tips likely when he broke character and started yelling at OP. I'll save my tip for someone who actually makes an effort.

Nothing was taken from the performer, because he didn't do anything. If you want to call putting on different clothes than you or I would wear..well I don't call that doing something. And standing still certainly isn't doing something.

By your logic then anybody in a tip-based profession should have the right to follow people back to their cars and yell at them as well.

It goes back to an earlier point. Dude KNOWS what kind of "business" he is in. He gets no paycheck. He has no salary. He may get tips one day, or get none the next. That is the nature of his chosen path. Someone choosing not to tip him absolutely does not make him right for chastising op.

Pretty much, no different than most of the folks on Calliope St anyway.

Should we tip the guys with Jesus crosses and signs that say "You're Going To Hell" if we want to take their picture as well?

I usually ask to see their last 3 years tax returns before I tip.

If they can't produce the tax returns, then no tip for you.

sure why not?

luckily in this instance the guy was self employed, so he couldn't get fired

it is pretty shitty to take a pic of a street performer and not tip them, it's just a social etiquette thing

you are acknowledging his "art", whether you believe that it is art or not

Wrong. But you do run the risk or retribution by not tipping. That's the point. You dont have to tip but dont be surprised if you get something in return. Like yelled at, or your food spit in.

The basic definition of performing : present (a form of entertainment) to an audience. Putting on a costume and make up and standing in a crowded area with the understood and expressed purpose of entertaining those people is most definitely performing and if you cant appreciate or understand that then there is no use arguing with you. I told you I understand where you're coming from. The tip is not required, but i then laid out my side. The inability to see the other side or admit that there is any merit in it means this is an exercise in futility.

So acknowledgement is the criteria now? If two people were walking by and stopped and said "huh, would you look at that?" and kept going, should they have tipped too?

1099 only required if you pay him more than $600 so its probably all good.

If you give him more than $14,000, you'll have to pony up gift taxes.

And he knows witih 100% certainty that he doesn't get a paycheck and some people may not choose to tip him. The people (multitude of people actually, thousands) that choose not to shouldn't get followed and harrassed.
