You left this part of of your original post. If he was executing a detainer than I would almost certainly assume he has been conscripted by ICE to execute it under some specific task force.

Don't know what I left out. As I stated the city took the 287g program.

We also dont know really what happened since the city does not have a legitimate licensed jail.

All prisoners that have to be detained overnight are sent to another county and the city is charged $60 per day.

So most likely he was just detained until ICE did arrive.

I think what people have been saying is that both could be possible and need more information on the officer being authorized both by the department and ICE, and also if truly enforcing something in the memorandum of agreement and following ICE direction to know if in specific detainment he was correctly following memorandum to be authorized. When the head of the police department signs the memorandum it doesn’t automatically place all officers in the Task Force Model program. There is a process of picking, approving, and training which we don’t know about this particular officer without making assumptions.


From the MEMORANDUM OF AGREEMENT
287(g) Task Force Model

…Only participating LEA personnel who are nominated, trained, certified, and authorized, as set out herein, have authority pursuant to this MOA to conduct the delegated immigration officer functions, under ICE direction and supervision, enumerated in this MOA.

… The chief officer of the LEA will nominate candidates for initial training and certification under this MOA. For each candidate, ICE may request any information necessary for a background check and to evaluate a candidate’s suitability to participate in the enforcement of immigration authorities under this MOA. All candidates must be United States citizens. All candidates must have at least two years of LEA work experience. All candidates must be approved by ICE and must be able to qualify for appropriate federal security clearances and access to appropriate DHS and ICE databases/systems and associated applications.

… Upon the LEA’s agreement, participating LEA personnel performing immigration-related duties pursuant to this MOA will be assigned to various units, teams, or task forces designated by ICE...

… ICE will certify in writing the names of those LEA personnel who successfully complete training and pass all required testing. Upon certification, ICE will provide the participating LEA personnel with a signed authorization to perform specified functions of an immigration officer for an initial period of two years from the date of the authorization. ICE will also provide a copy of the authorization to the LEA. The ICE supervisory officer, or designated team leader, will evaluate the activities of all personnel certified under this MOA.

Authorization of participating LEA personnel to act pursuant to this MOA may be revoked at any time and for any reason by ICE or the LEA. Such revocation will require notification to the other party to this MOA within 48 hours. The chief officer of the LEA and ICE will be responsible for notification of the appropriate personnel in their respective agencies. The termination of this MOA, pursuant to Section XVIII below, shall constitute revocation of all immigration enforcement authorizations delegated herein.

… Immigration enforcement activities conducted by participating LEA personnel will be supervised and directed by ICE. Participating LEA personnel are not authorized to perform immigration officer functions except when working under the supervision or direction of ICE.

When operating in the field, participating LEA personnel shall contact an ICE supervisor at the time of exercising the authority in this MOA, or as soon as is practicable thereafter, for guidance...

Let’s assume he was certified and authorized to act. Why wound it be a surprise to anyone if the city already approved this?

Are you just having a semantics argument with yourself or are you trying to challenge his legal authority to detain an illegal?

Since the place is such a known speed trap that every citizen drives miles to go around it. It doesn't help now that ever single Hispanic person is scared to come into the area as well now too. Cause even if they are legal, they don't want harrassed.

Ahh, you're upset about potential immigration enforcement and are trying to challenge local authorities. Why not just say that to begin with? What business do you own that's being impacted?

If your mother showed you how to peel a banana, does that make you a monkey?

So if the officers city joined 287G to be able to ask more specific questions and look for more specified paperwork, does that mean he is part of the ICE Task force?

Or just the city is part of the 287G program.

If you dont know the answer, just say you dont know.

I am not complaining about ICE.. Only questioning the cops statement.

I know this guy.. he was fired by the city once.

He came before the city council to ask for his job back. He brought every meth head, crackhead in the neighborhood. They all raised their hand and said: He arrested me and I want him back."

It was laughable if it wasn't so pathetic .. I so wish I had a camera for that meeting.

Answer is that it is quite possible that he is a task force officer. My thinking is that he surely knows that falsely representing such a status is a federal criminal offense and also a state offense, so I would bet that he is a task force member. Such a status is not hard to get for an officer with a good reputation.

Better question is what difference does this make to you?
