Yes. It didn't show premeditation.

The perp could literally get on the stand and scream he hates cyclists and goes out actively seeking to run them off the road and idiots on here would still be on his side.

I doubt he meant to actually hit the guy. He more than likely just wanted to scare him.

The charges should be the same either way though

Yet one fool insists that he did without evidence.

This reminds me of these cases where people get shot by cops after they pull a gun out. The media piles on because of the race angle and always finds in the black community that insist the whole thing was planned in advanced by the police.

You keep saying this and keep failing to provide evidence to back it up.

It's an accident until proven otherwise.

This is destroying evidence?

So if I rob a bank in a red shirt then the next day they arrest me in a white shirt I can be charged with destroying evidence?

Tennessee's Civil Justice Act tort reform law has really hamstrung the amount of damages one can get. Given the caps and the (presumptive) insignificant injuries the cyclist sustained, I doubt the number will be shocking.

It's a stretch, but I could get there.

I don't see how a video of a hit and run proves some malicious plan to intentionally hit a cyclist.

It doesn't.

The testimony of other witnesses of previous aggressive behavior does.

Not quite just keep peddling. One day you might reach the speed limit on the roads you block.
