Just because it's legal doesn't mean it's the safest way to do things. If a vehicle is coming, move over. It's safer for everyone.

It doesn't have to mean that he intended to hit someone.
If it is true that this has happened on more than a few occasions in the past, the US Attorney can introduce testimony that Neely clipped them, tried to hit them, ran them off the road, etc. to simply show that this wasn't an accident, or this wasn't some mistake, or that he had some vindictive motive towards cyclists, etc.

The fact the dumbass on the bike is putting along in the center of a highway matters.
The guy driving the "deadly weapon" is all the way wrong, but doesn't deserve 37 years for that little tap.

Your driving down a winding road posted 45mph. All of a sudden you get behind a car going 15 mph forcing everyone to pass them one at a time when they can.
Is the driver of the car going 30mph under the speed limit a douchebag?

It is designed for both. It just so happens it is a very popular cycling route. Cyclists need to be aware that there are some instances where they shouldn't ride two abreast. Vehicles need to be aware that they may have to yield to a cyclist prior to passing them.

i see 40,000 pound RV's are allowed and I also think some cyclists have confused the words designed and designated to mean the same thing
