Damages and emotional distress. Even if you win you will pay out this arse in attorney fees.

So if your property damages my property, you should not pay?

If your property kills my propery, should there be no indemnification?

They took the risk. Sucks for them. I get that they are family friends, but they are over-reacting.

For a dog? Are you sure about that? That sounds ridiculous to me.

Not saying it does Rouge. Just saying....dogs fight, they are animals after all.

I'm a huge dog person but even I understand that dogs do fight with each other when provoked.

If something like that happened to Butters I would want him cared for but would not be seeking for the other dog to be put down, esp if I knew the other dog didn't have a history of aggression.

If I wasn't there or someone else wasn't made known of my dog's tendency to display lil dog syndrome when crowded by big dogs, I would realize that my dog's actions likely was part of the problem as well and i should have been watching him or having someone else watching him....ESP with a large dog he's only met once.

It is but they will likely still bring the suit and he will be stuck paying a lawyer to defend it.

the dog was 15 years old, not like it had but maybe a couple of years left at best. Them trying to get anything out of this would be like a basketball team trading a player in their contract year just to get something out of them before they are gone for good.

And lester was negligent for not having his dog on a leash.

You reimburse the value of the property. What would a 15 year old dachshund be worth?

I think the issue of liability is not so clear. The owner of the dachshund may be partially liable for their own dog's death, thereby making Lester put his own dog down overkill.

Both dogs were off their leashes. Apply that to both parties.

He'll decide based on comparable sales so probably about $25.

He said the beach was dog friendly so I don't know if a leash was required...kinda like at dog parks. I don't know if negligent is the right word since his dog is 7 and has never attacked ANY other dog but IMO he is responsible for the other dogs medical bills.

It doesn't matter IMO. I would pay anything to save the dogs life if my dog was responsible

and that is the problem, how do you know if your dog was responsible? If you put your dog, or child for that matter, in bad situations don't get angry when bad things happen. If you have a small dog, don't put it around big dogs that they aren't familiar with. That is being an irresponsible pet owner. I don't know the whole story here so I can't really say who was at fault or not but neither of my dogs leave my house not on a leash and I am aware of everything around them when I have them on a leash.

Ya but who started it? I mean his dog could have been acting in self-defense and we all know how that plays out in Florida!

without anyone seeing what actually happened other than the tail end of it no one can decide which dog is to blame for the situation. pay the medical bills, keep a better eye on your dog in the future and be done with it.
