It's called a hypothetical. Since we don't know much about the dachsund, it is as equally unfair to assume it was "innocent" in this whole debacle.

I prefer to deal in FACTS and when you do that LEs dog is 100% at fault. It sucks but its the way it is.

Lately, immigration, construction, and DUI. I want to get into bankruptcy, but that's a hard gig to get into.

issues is that you are trying to deflect towards an, as of yet, unknown history with a little dog as opposed to the facts of the incident, as we now know them

Les' property caused damages to another man's property. Assuming the animal lives, Les will have to repay medical bills at a minimum. In your situation, you are recommending he go to litigation and incur even more costs in a situation that he WILL NOT WIN.

this is easy property law at this point.

sounds like a clear case of Stand Your ground on Lester's dog's part.

I never advised him to litigate, so you can stop putting words in my mouth. This is all academic discourse. You are the one assuming liability by invoking negligence by one party while assuming the other party cannot possibly be negligent. I am only questioning such a rushed conclusion.

He's upset right now. Try to sit on it a couple of days and he'll probably cool down and come to senses.

you advised Lester Earl, and I quote, "Tell them to get lost."

you can review the record for yourself.

shite....if those are your 3 specialties why aren't you living in Arizona? We have the most Mexicans here so you would be set with immigration. Also, construction is BOOMING out here right now, Mexicans do a lot of the labor, so you would have ton of business in that field. Oh...and we have the toughest DUI laws in the country. I am sure you do well but I think you would clean up out here!

I skimmed the thread and didn't see where exactly this happened, and the circumstances...

if it were on their property, I might be concerned.

If not, dogs are dogs. I would be reluctant to offer financial consideration. How is dog behavior more your responsibility than theirs?

I mean really, a 15 year old dog? That poor dog is on his last leg already, probably can't see very well, and probably started this anyway.

Offer something like, hey, I'm really sorry this happened, good luck with your pup!

It's not like they had a 2 year old prize dog and might lose some revenue.

Perspective.
