I read your subject title rather skeptically, but:

Usually the circuit judge does not see the suspect until after indictment. If he or she has been arrested prior to indictment, a muni or justice court judge usually handles the case and sometimes appoints a public defender.
Upon indictment, its a new judge and things change. He can hold a hearing on indigency and appoint counsel. The appointment of counsel prior to indictment is usually not his responsibility by practice or under the law.

Meh, the company I work for deals with 2 judges in MS that are 100X worse. One doesn't even know the law and shite stays clogged in the system forever because she can't make a decision. The other doesn't care what the law says, he's just going to do it his way. Take your pick....turd sandwich or giant douche.
