Generally in a sexual encounter, there's some reciprocation of activity, is there not? This sounds like she was asleep in bed, he got into bed and started feeling her up. When she woke up enough to realize what was happening, she stopped him. It's not like they got into bed, started kissing, fooling around and mutually doing whatever... it was one sided with the other side asleep.

That ain't no "first move". If it is, your "game" needs serious work.

I have been passed out on the couch at apartments, gotten up, and gotten into bed with women.

Not rapey, just not sleeping on a couch.

Most times it lead to other things.

There might be things that she omitted that would change my mind but based just off her version I'd say probably. At the very least, if it happened like she said, it's a creep move.

I don't think it's to the level that she should have made the accusation a few months after his death.

If the person is unconscious, it sure seems like it...especially if they are not in a relationship or don't have any "history."

After reading up on what happened, she said she pretended to be asleep because she was scared and hoped he would get bored and go away if she didn't respond (she was 17). Assuming what she said is true...it's also fair to assume that he thought she was asleep as he did all the kissing / feeling until she made it clear she was awake and told him to stop.

Seems pretty bad to me. I don't consider kissing and groping of what appears to be a sleeping woman as a "move." But once again, it's hard to get the full story in this case because the guy is dead and there's nobody that has come forward to corroborate what happened. Maybe they had a consensual sexual history?
