Of course dumbass. Not saying no doesn't mean yes. What a fricking creepy move
The dude went and started feeling up a sleeping drunk chick for God's sake
This is the only correct answer.

First move is maybe putting your hand on her waist at the party and seeing how she responds. Jumping straight into bed without being invited? Come on....don't be dense.

Did she say anything before he was too dead to defend himself?

Can't believe her until you hear his side of the story.

What is active consent?
Active consent means affirmative, honest, conscious, voluntary, sober and ongoingagreement to participate in sexual activity. Each person involved is responsible for ensuring that there is active consent to engage in each sexual act.
Active consent is not:
o Silence
o Lack of protest
o Lack of resistance
o Assumed to exist based on a past or current sexual, dating or marital relationship

I couldn't resist:

He was a skater boy
She said, "see you later, boy"
He wasn't good enough for her

I guess now you must verbally lay out your upcoming sexual encounter before doing so... that sounds real hot.
Generally in a sexual encounter, there's some reciprocation of activity, is there not? This sounds like she was asleep in bed, he got into bed and started feeling her up. When she woke up enough to realize what was happening, she stopped him. It's not like they got into bed, started kissing, fooling around and mutually doing whatever... it was one sided with the other side asleep.
That ain't no "first move". If it is, your "game" needs serious work.

The only thing I can say is that if every guy who tried to make a move and got rejected was charged with sexual assault, the U.S. legal system would be swamped.
I wouldn’t describe sneaking into a drunk girls bed as “making a move”

I have been passed out on the couch at apartments, gotten up, and gotten into bed with women.
Not rapey, just not sleeping on a couch.
Most times it lead to other things.

Is that sexual assault ??
I don't think it's to the level that she should have made the accusation a few months after his death.

If the person is unconscious, it sure seems like it...especially if they are not in a relationship or don't have any "history."
After reading up on what happened, she said she pretended to be asleep because she was scared and hoped he would get bored and go away if she didn't respond (she was 17). Assuming what she said is true...it's also fair to assume that he thought she was asleep as he did all the kissing / feeling until she made it clear she was awake and told him to stop.
Seems pretty bad to me. I don't consider kissing and groping of what appears to be a sleeping woman as a "move." But once again, it's hard to get the full story in this case because the guy is dead and there's nobody that has come forward to corroborate what happened. Maybe they had a consensual sexual history?

Reading through this thread has made me so fricking pro prostitution.
Charlie Sheen said it best. "I don't pay them to have sex with me. I pay them to leave after I finish".
Some guy tried to frick her. Big fricking deal.

Let's say that is you...you are laying there asleep and some guy does that to you and you wake up...How do you respond?
