It's a shame you can't ever hear his side of this story. If she pretended to be asleep, then it's partially on her. If some guy or girl got in my bed that was unwanted and started touching me I'd tell them to GTFO.

Also, all women are different in how they get turned on or get sexually approached. What one girl enjoys can be vastly different than the next and that's another reason these are murky waters.

What if he thought she was awake the whole time and just playing it off? If that was truly his mindset, which I'd assume it was given the second she said no he backed off. If he was raping her, one no from her wouldn't likely fend him off immediately. People need to use common sense and there's two sides to every story.

It’s kinda hard to say without hearing his side of the story.

What if they were flirting all day and kissed at some point.

Maybe she told him to come sneak in her room after everyone went to sleep.

That happens a lot.

We just don’t know his side of the story

Then my best guess...if we are just going to make random assumptions...is that if she asked him to sneak in after everyone went to sleep they would have probably had sex and we would not be hearing about it.

The indecent assault he committed before being told no. He did not have consent to touch any erogenous zones. Had he laid in bed and given he a back rub he would not have crosses any lines.

If some dude tried to do that to me I would most likely be charged with assault and battery. Would it be assault if a woman did this to a man or would it get laughed at ?

What if he truly thought she was awake the whole time and enjoying it? What if he thought if she was actually asleep he wouldn't be doing this? Would that change your opinion?

This #MeToo thing is always quick to blame the guy, but what if his mindset was right and he just totally misread the situation? Should he be labeled a rapist like someone who storms in there and physically rapes her despite her cries screaming no? I am all for the MeToo thing when its clearly warranted and a predator goes to jail. I am not for MEN not getting a chance to tell their side and getting prejudged by the rabid SJW world we live in today.

Then she probably would have participated or reacted positively instead of laying there like a dead fish. This isn’t that difficult to figure out.

I guess you've never hooked up with a girl you had to foreplay with a little more than the others? Seriously, sometimes I have to feel up the gf pretty good these days to get her in the right mood and preheat the oven a bit...she enjoys it. If she was awake and didn't say no while doing this (like claimed) then it is reasonable to assume he thought she was awake during this time too. Are you saying that she has to verbally say "yes, please continue" to give consent?
