The picture in this article shows, McKnight's car on the passenger side of Gasser's car. McKnight's body is behind and between both cars. My guess is McKnight was on the passenger side of Gasser's vehicle when he was shot.

And if that's the case, is Joe really in range for a fight? Wouldn't he have gone to the other side of the car?

Your trying to argue with the liberals they won't ever give up, slackster wants you to get out of the car and hug the angry man at your window. Just give him a kiss on the cheek and help him through his anger in such a situation if it ever happens to you

Amazing that all this info has been released so quickly. Usually it's several days. Dude hasn't even been dead for 24 hrs yet.

Is there no restraint anymore? You just brandish your pistol and start firing? That's where I'm getting caught up with all this

Which is not grounds for justifiable homicide. You have to believe your life is in danger. You can't argue that you didn't know what the hell he was going to do. You have to argue that you believed your life was in imminent, grave danger

Agreed

Riot would be justified

That is pathetic

A riot is never justified...... If you think this, you have no respect for peace or lawful activity.

I agree in general, but I don't think that is so as a blanket statement. If McKnight was driving erratically and following him, then got out and approached, putting myself in the dude's shoes, I may very well fear for my life without the person saying a word, just approaching my car might be enough.

Yeah you can add more qualifiers that make it justifiable, but the basis that the approach and arguing back and forth is enough grounds is not true.

Reading the statutes on the page or so back, it appears to me that he could also argue that McKnight was trying to enter his vehicle. He wouldn't have to feel imminent danger, just that he was trying to invade his dwelling without permission.

If I'm blocked in at an intersection and some dude is standing at my door yelling for me to get out the car so he can frick me up(this is just speculation), I can't shoot him?

You can but you may or may not go to jail and you will also probably bankrupt yourself in legal fees. Smart thing to do is keep your windows up, lock the doors, and call the police.

Did you miss the part where Gasser was released with no charges?

Just so we're abundantly clear, if Joe got out and they were arguing at Gasser's window, Gasser does not have legal grounds to shoot him yet. If Joe tries to get into the car or if Gasser reasonably fears that his life is in imminent danger, then he's justified, but those grounds have to be met. You can't just shoot someone arguing at your window.

If Joe got out and they were arguing at Gasser's window...

I'd suggest that it's definitely reasonable to say it's at least arguable that Gasser would have felt his life was in danger.

And, that's the point. Anyone trying to make definitive legal arguments of a subjective situation is crazy. It's not crazy to suggest that the argument of feeling threatened is reasonable. And, to counter that, one would have to argue definitively that it is not reasonable.

You seem to be really put off when people suggest that it's reasonable that he may have felt that his life was threatened.

If I have a big 20-something professional football player at the window of my car trying to go HAM on my arse for some reason I'm thinking my life is in imminent danger.

Perhaps Joe was pissed at gasser for cutting him off on the bridge. Maybe Joe has CTE and had blown a fuse on this guy. Maybe those "witnesses" are lying their arse off.

All I know is if that one "witness" totally made up this stuff about the man standing over McKnight and finishing him off while saying "I told you not to f... with me", she needs to be in jail
