If anyone of any color gets out of car and you feel threatened, you can legally shoot them. This is what the law says, period! That's fact 1
Fact 2 is not one of the Matlock wannabes on here know the full story so disregard every single thing on here! Learn from the past!
What law is that exactly?

The Shell station if back a ways from the street and Mcknight's SUV was in the way. The other business is car way about 200yds away. If they caught anything it will likely be useless unless they have some serious equipment.
Figure in this day and age, some nosey bitch would have pulled out her I-phone and got some vid

Yeah, but unfortunately that presser is about 4 hours too late. Whatever information you had to justify his release before 9AM should have come out then. Letting it fester for 4 hours is irresponsible.
This. Shooting was at 2:45. Newell spoke live to reporters at 4.
That was after driving to the scene.
Yet they release the man at 9 and wait till one to speak?
Bad timing by the JPSO.
If they have a smoking gun that exonerates this guy it should have come out before they released him.

If they're already referring this to the DA, it's likely a weak case with conflicting info and they want to throw this in front of a grand jury quickly.
Yeah, it would be unfortunate if this is all relying on a he-said, she-said situation where one party is deceased.

Witness statements are often bullshite
Look at the Scott killing here in Charlotte. Each of the witnesses were proven liars.

Witness testimony is notoriously inaccurate and often differs greatly from physical evidence.

Wise decision to edit there.

Gasser should have drove away
Are you serious? You know the correct conjugation for the action verb is driven, do you?
You should have driven, he should have driven...

There has to be at least one of those floating around. That's a busy arse intersection and plenty of people were giving their accounts. It would be a miracle if no one pulled out their phone.

I mean this isn't true at all.
quote:
(4)(a) When committed by a person lawfully inside a dwelling, a place of business, or a motor vehicle as defined in R.S. 32:1(40), against a person who is attempting to make an unlawful entry into the dwelling, place of business, or motor vehicle, or who has made an unlawful entry into the dwelling, place of business, or motor vehicle, and the person committing the homicide reasonably believes that the use of deadly force is necessary to prevent the entry or to compel the intruder to leave the premises or motor vehicle.
They'd have to be trying to get into your vehicle for it to be lawful. You can's just shoot them if they get out and you're scared.

making threats of violence etc... very likely.

It's going to be interesting to see what they say at the presser. When they rush to throw it to the DA, it usually isn't good for the prosecution side.

Regardless, JM might have been in the wrong, Gasser might have been in his right to protect himself, but I have been in this situation before. I cut a guy off and both of us were just enraged. He followed me, etc. the situation could have ended the same way. So stupid. Best to avoid, and let people win on the road. PSA over.

If McKnight got out arguing with him and made his way to the drive window where he was then shot, that is not justifiable.
I don't believe this is correct. I remember a story that happened in Central (Louisiana) a couple of years ago where one brother(?) or friend(?) found out that there was some cheating going on and they had a big car chase through Central. It ended when one guy got out of his truck and started approaching the window of the other vehicle. The guy in the vehicle shot and killed the guy walking up and he was not charged with murder/manslaughter. They said he was justified in doing so.
So, if you don't want to get shot...don't get out of your car. Pretty simple.

The key is intent. What is a person's intent when they angrily approach your vehicle? It's not to hug it out...lol

Only if you have a REASONABLE fear of imminent death or grave bodily injury.
