I'm currently looking for the text of the EO, but can someone explain to me how this is possible? Congress sets the schedules by statute. I can't conceive of how he could change that via EO. And I say that as someone who thinks this is a good thing.

No it hasn’t. The DEA still has to approve it, the executive order is just speeding up the process.

I've traditionally supported this stuff but I might be reversing course

The amount of people reeking of weed and smoking in public is just out of control. It's aging me and I'll start shouting at clouds soon.

I don't believe an executive order can change the classification, but it can set things into motion.

My understanding is that it's a DEA/Congress thing and can't be done by EO.

DEA was scheduled to have hearings on it towards the end of Biden's admin, but it got delayed.

DEA has already had the process going. They opened public comments last year and are still reviewing them. This just speeds up the process.

Congress only passes budgets now and they pile in other BS into budget bills as they can. Then everything else is done by EO and fights its way through the courts. It's an expensive jobs program.

It appears that the EO will direct the DEA to finalize a rule that has been working its way through the rulemaking process. The rule will actually perform the reclassification. Most likely there is statutory authority for that.

The text of the EO has not been published yet that I can tell.

I mean when medical marijuana is passed in Alabama, you're on the wrong side of history trying to outlaw it.
