Legally the kids were under no obligation to help the guy, falls I think under “no duty to act”, the filming would be no different than a news videographer filming someone being beaten to death by a mob, he would not be required to drop his camera and help the guy.

A citizens arrest is completely legal in the state of Georgia. Lethal force is warranted in situations where self-defense comes into play.

For a felony.

There's video of Arbery at the construction site and he doesn't take anything. So, it's a misdemeanor trespass and there's no right to make a citizens arrest.

But why?

We know they didn't meet the standards of a lawful citizens arrest. They admit this.

So why do you think they walk?


Their whole credibility is shot to shite anyway once the prosecution compares their statements to the police contrasted with the video. The jury won't believe a word they say. They lied to the cops already, why believe anything else they say about the incident?

After watching that video several times, it looked as if Arbery grabbed the gun in self defense. As if he felt like they were going to shoot him and at that point his only option was to try to get the gun from him. It was a high risk move, but in those seconds, especially since a shot was already fired he acted as if that was his only way to defend himself.

Otherwise, you do not go in front of someone who is holding a gun that is pointed at you and try to take it out of their hands.

To make the arrest, an employee would have had to actually see the criminal act committed. Therefore, it was ruled that management had no authority to arrest the alleged criminal.The court suggested that the only person who could have made the citizen's arrest was the robbed customer herself. When making a citizen's arrest, a person may not use more force than is reasonable to make the arrest. Deadly force is limited to self-defense or to instances in which such force is necessary to prevent certain felonies.[/img]

the 2 mcmichaels are facing the death penalty or life if they are lucky/plead guilty. The third is going down for a felony, maybe not murder.

They had a guy brandishing a firearm in the bed of a truck while chasing someone down. And JR jumping out aiming a shotgun at someone in an illegal citizens arrest. That’s insanity. No reasonable person should think its acceptable for tater tot to go captain retard and spray lead over a crime they had no knowledge of occurring.

That’s not the same thing… They witnessed him illegally entering a dwelling. Management at Winn-Dixie took the word of a shopper that she was robbed. Apples and oranges.
