Senate Bill 98, sponsored by Senator Patrick McMath (R-Covington), consolidates four other bills dealing with the use of cell phones while driving.

McMath said the bill would allow drivers to be punished for using cell phones in specific scenarios. This includes when caught using a cell phone in a school zone or when stopped for another offense.

Opponents of the bill argue that drivers face numerous distractions beyond cell phones, such as alcohol or other people in the vehicle. Despite these concerns, the bill passed unanimously in the House Transportation Committee and will now proceed to the full House for debate.

The bill proposes fines of up to $1,000 and the potential loss of a driver’s license for two months for some offenses. These fines could double if the cell phone was being used during an accident.

I'm assuming this one goes beyond just texting and driving. It probably includes zero use of a cell phone unless it is hands free.

It was already against the law to use a phone in a school zone. This bill seems to ban any handheld phone use while driving, regardless of location.

That being said, the bill says that cops can only pull you over for it if it happens in a school zone. Otherwise, it’s just a secondary offense (i.e. they can add it to your ticket if you get pulled over for something else).

Other notes:
- The bill appears to ban basically any handheld usage of a device, whether that’s calling, texting, browsing TD, whatever.
- The bill does not ban handsfree usage. Although it does seem to ban any “manual entry” of names or numbers.

Seems like it’s probably a good thing. But also seems unlikely to change anything considering they can’t pull you over for it unless in a school zone (which they can do now).

So the plan to get this thrown out was to say we shouldn’t ban cellphone usage when driving because other things can also distract drivers? I want to know if they thought of this defense on the fly or if this was a prepared and thought out argument

I want to ban parents who give their toddler/adolescent kids cell phones to blast their favorite cartoon shows in public!

It blows my mind how many can’t drive somewhere without looking at their phone. Mine stays in pocket on silent until I get to where I am going. That phone call can wait believe that. Another form of government overreach where it wouldn’t be needed with an intelligent society.

People commit attempted murder and are almost immediately back on the streets. I really doubt this is going to change any behavior. There aren’t any consequences.

I wonder if it applies to police officers, I often see them holding up their phones near their steering wheel when I pass them.
