That's not what happened.

The schools are considered the victims here, much like the college basketball scandal. They were defrauded by Loughlin and others into giving a spot to a candidate on the premise he/she was an athlete. Loughlin got that spot by donating money to a "charity" that funneled it to the people in charge of the scheme. You're guilty of conspiracy to commit money laundering if you transfer money for the purposes of illegal activity. Claiming that transfer of money as a tax deduction brings tax evasion into play.

ETA - Tax evasion on it's own is, by definition, a form of money laundering too.

I can only assume that a judge would see that this is a bit heavy handed and not impose that kind of sentence.

This is one of those things that every person knew was happening, but no one knew it was actually illegal. Why aren't private schools allowed to accept students just based on donations?

ok first she claimed she donated money to a real charity. she did not. she deducted this donation. that's going to be an issue with her taxes

this fund used the money to bribe officials to commit fraud

this fake charity/scheme also used its resources to, allegedly, hide the illegal nature of the money. that's laundering

she knowingly participated in that scheme, which means she's a conspirator

mail/wire fraud is a broad crime that allows prosecution if you use any sort of electronic means (or the mail) to further a fraud

in what way is this set of behavior not criminal to you?

*ETA: i'm not talking about the behavior being "criminal" in a moral way. i mean based on the laws of our country

Imagine getting a judge who has a child that was denied admission to the school based on accepted criteria.

Federal sentences are based largely on the sentencing guidelines. Here is some info on money laundering:
