there is an ethical rule in LA about this and they're not "retainers" in most cases. typically it's a fixed/flat fee contract
if it's a fixed-rate contract and it's terminated early, there may be recourse to recover the "unearned portion". he needs to speak to an attorney about it (his issue may be in a different state with different rules but i think this rule is pretty universal)

The Bar Association polices our profession. You’d ideally want to go through the Bar Association if you are in fact getting screwed with your billing before going through another lawsuit against your former counsel.

i read an ODC case a few months ago where some wacko in Nola charged some insane fee for a divorce and said it took 3-ish hours to write the petition

there are a lot of things i don't do and i tell all my clients if they have any legal issues to contact me first so i can direct them (no referral fee or any kickbacks involved) to a competent attorney in the area (who won't gouge them)

Well did he give you a breakdown of how he earned that $7k? Seems like you agreed to payment terms, he did work, and is now asking to be compensated for said work.

So if he already used your retainer he is saying he worked 40 hours on your case... Roughly. He may have also charged time for other Bs or workers or storage of documents,etc.

Yeah, you right. In this case, it’s technically an advance but he’s using it interchangeably with retainer.
